GENERAL REFERENCES
Vehicles and traffic — See Ch. 460.
As used in this chapter, the following terms shall have the meaning indicated:
SKATEBOARD
Any vehicle propelled by human power and gravity consisting of material or portion of material formed in a thin firm sheet(s) with wheels attached to the underside. This definition includes: roller skates, roller blades, and similar wheeled devices.
A. 
Prohibited locations. It shall be unlawful for any person to engage in skateboarding or ride upon, or propel any skateboard upon the following areas within the Borough of Littlestown, Pennsylvania:

(1) 
On any sidewalk within a one-block area of the square of the Borough of Littlestown, i.e., Maple Avenue west to Queen Street; Locust Street south to King Street; Lumber Street north to King Street; and Patrick Avenue east to Queen Street.
(2) 
In, within or across any intersection or street crossing.
(3) 
All Borough-owned property, except for designated areas.
(4) 
All private property posted with a visible sign specifying that skateboarding and/or trespassing is prohibited.
(5) 
On all municipal thoroughfares and streets.
B. 
Prohibited times. It shall be unlawful for any person to engage in skateboarding or ride upon or propel any skateboard upon any public sidewalk within the Borough of Littlestown:

(1) 
Between sunset and sunrise on any day;
(2) 
At any other time when, due to insufficient light, or unfavorable atmospheric conditions, persons are not clearly discernible from a distance of 100 feet.
A. 
Prohibited locations. It shall be unlawful for any person over 12 years of age (i.e., any person not otherwise required to wear a helmet under prevailing state law or local ordinance) to ride, propel or use any pedalcycle upon any sidewalk, footwalk, street crossing or other places set aside, use or intended to be used for the exclusive use of pedestrians, within the limits of the Borough of Littlestown aforesaid, except in the necessary act of crossing over such pavement, sidewalk or crossing.
B. 
Light required at night. It shall be unlawful for any person or persons to ride, propel or use any pedalcycle upon any road, street, alley, highway or other public place within Borough of Littlestown, from one hour after sunset until one hour before sunrise, unless there be displayed upon the front of such pedalcycle a lighted lamp, as well as a lighted lamp or reflector on the rear of or visible from the rear of such pedalcycle, both of which must be visible from a distance of at least 500 feet, and at least 1 1/2 inches in diameter.
A. 
A person shall obey the instructions of a police officer or other appropriately attired person authorized to direct, control or regulate traffic.
B. 
A person shall obey traffic and pedestrian control signals as provided under Pennsylvania Motor Code, Section 3112 (relating to traffic-control signals).[1]

The person shall yield the right-of-way to any pedestrian and may not overtake or pass a pedestrian while riding upon or propelling the skateboard or pedalcycle. The operator of such skateboard or pedalcycle shall dismount and shall pass or overtake the pedestrian on foot, or wait until the pedestrian passes, prior to remounting the skateboard or pedalcycle.

No person engaged in skateboarding shall suddenly leave the curb, sidewalk, or any other place of safety and ride upon or propel any skateboard as to constitute a hazard.
No person shall place a ramp, half-pipe or other structure used for skateboarding or bicycling in a public thoroughfare, street, upon a sidewalk or municipally owned property.
It shall be unlawful for any person to operate a skateboard or pedalcycle in a manner which would cause bodily injury to the rider of the vehicle or pedestrian or in any reckless manner. It shall be unlawful for any operator of any vehicle to cling to any other moving vehicle.
Any person 12 years of age and under shall not operate a pedalcycle or skateboard or ride as a passenger on a pedalcycle unless such person is wearing a helmet meeting the standards of the American National Standards Institute and the Snell Memorial Foundation's Standards for Protective Headgear, and, in general, any and all persons operating or riding upon a pedalcycle or skateboard shall, at all times, comply with federal, state and local laws, rules, regulations and ordinances regarding protective helmets.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof:
A. 
First offense. The skateboard, pedalcycle, ramp, half-pipe or other structure used for skateboarding or bicycling used in violation of this chapter shall be impounded by the Police Department of the Borough for a period not exceeding 15 days. If the person violating this chapter is a minor, in addition to the confiscation of the skateboard or pedalcycle as aforementioned, the Borough Police shall notify the parents, guardian, or other person having legal custody of said minor of the violation of this chapter and the impounding of the skateboard or pedalcycle. In addition, said individual shall be provided with a copy of this chapter.
B. 
Second and/or subsequent offense. The skateboard, pedalcycle, ramp, half-pipe or other structure used for skateboarding or bicycling of any person violating the provisions of this chapter for the second and/or subsequent time shall be impounded by the Police Department of the Borough for a period not exceeding 30 days and said person shall, upon conviction, be sentenced to pay a find of $50 and costs, to include costs for collection and storage. In the event said person is a minor, the skateboard or pedalcycle of said minor shall be impounded by the Police Department of the Borough for a period not exceeding 30 days and the parent, guardian, or other person having legal custody of said minor shall be, upon conviction, sentenced to pay a find of $50 and costs.
