The provisions to this chapter shall apply only to dock slips owned by the Borough which are leased by the Borough for the summer tourism season through its public auction and bid process. The aforementioned dock slips shall be clearly marked by the Borough.
No person shall dock a boat at a leased public dock slip in the Borough of Beach Haven without first having obtained a permit for such privilege in the manner set forth by the Borough, nor shall any person use, take or occupy one or more boat slips or spaces until a permit for that purpose has been obtained. No person shall use or occupy a slip after the expiration of a duly issued permit. The Borough shall, by resolution, designate the number of and which slips shall be designated for permit-only seasonal use. The remaining slips shall be designated for transient use. No vessel shall utilize a transient-only designated slip between the hours of midnight and 4:00 a.m. The Borough shall erect appropriate signage related to the slip designation and usage restrictions.
No person shall use the public docks or any part thereof as a boat slip or space, except that portion of said dock now or hereinafter set apart for boat slips or spaces.
After the issuance of a permit for docking a boat at a public dock slip, no other boat shall occupy the slip, except the boat designated on the permit, without the consent of the Borough of Beach Haven, which must be given in writing.
Permits issued by the Borough for the use of boat slips cannot be assigned or transferred to another individual under any circumstances; provided, however, that if a permit is issued to a husband and wife, upon the death of either the husband or the wife, the permit can be transferred to the name of the surviving spouse. Any change in the identity of the permittee or ownership of the permitted boat shall require a new application for a boat slip permit.
In the event the lessee and/or owner of the boat refuses to remove the boat, and after written notice from the Borough, the Borough may remove the boat. The lessee and/or owner of the boat shall be liable to the Borough for the cost of removal of the boat.
Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $1,250, imprisonment for a term not to exceed 90 days and/or a period of community service not to exceed 90 days. The continuation of such violations for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
