Approval by the Township of any proposed subdivision of land, site plan, conditional use, variance, or building permit requiring the disturbance of more than 5,000 square feet of the surface area of land, for the accommodation of construction for which the State Uniform Construction Code requires a building permit, shall be conditioned upon certification by the Burlington County Soil Conservation District of a plan for soil erosion and sediment control, as required by the Soil Erosion and Sediment Control Act, N.J.S.A. 4:24-39 et seq., and by the rules and regulations promulgated thereunder by the State Soil Conservation Committee in the Department of Agriculture; provided, that the construction of a single-family dwelling unit shall not require such certification unless such unit is part of a proposed subdivision, site plan, conditional use, variance, or building permit application involving two or more such single-family dwelling units.
No certificate of occupancy shall be issued by the Township for any project described above as requiring certification of a plan for soil erosion and sediment control, unless there has been compliance with the provisions of a certified plan for permanent measures to control soil erosion and sedimentation.
The Township may enforce compliance with the provisions of the Soil Erosion and Sediment Control Act, regulations pursuant thereto, and certified plans by such means as are provided by law, including the issuance of stop-construction orders, institution of civil actions in the superior court for injunctive relief, and imposition of penalties to be collected in a summary proceeding pursuant to the Penalty Enforcement Law, N.J.S.A. 2A:58-1 et seq.
