[HISTORY: Adopted by the Town Board of the Town of Milan 6-13-1966. Amendments noted where applicable.]
This chapter shall apply to the territory of the Town of Milan, Dutchess County, New York.
It shall be unlawful for any person to willfully do or cause or allow to be done, any of the following acts:
A. 
Unnecessary noises generally. To make or cause to be made or permit any unnecessary or unlawful noise between the hours of 11:00 p.m. and 7:00 a.m., which annoys, injures or endangers the comfort, repose, health or safety of others, or to make or cause to be made between said hours, whether in the operating of any machine or the exercise of any trade or calling or otherwise, any noise which annoys, injures or endangers the comfort, repose, health or safety of others, unless the making of the same be necessary for the protection or preservation of property or of the health, safety, life or limb of some person.

B. 
Music. To permit or be engaged in or to permit others to engage in the playing or furnishing of any music or entertainment of any kind, including vocal or instrumental music and mechanically or electrically reproduced music or sound, out of doors, in any public or private place whatsoever, between the hours of 11:00 p.m. and 7:00 a.m.
C. 
Radio and other mechanical devices. To maintain and operate between the hours of 11:00 p.m. and 7:00 a.m., in any building or on any premises in the Town of Milan, any radio devices or mechanical or other musical instrument or device of any kind whereby the sound therefrom is case directly upon the public highway and where or not such device is maintained and operated for advertising purpose or to attract the attention of the passing public or which is so placed and operated as to cause annoyance or inconvenience to travelers upon any highway or public place or to persons in neighboring premises or which annoys, injures or endangers the comfort, repose, health or safety of others.
Any person who shall violate any of the provisions of this chapter shall be guilty of an offense and shall, upon conviction thereof, be punished by a fine of not more than $250 or to imprisonment not to exceed 15 days, or both, and each day on which such violation shall continue shall constitute a separate offense.[2]
