The Town Board hereby determines that it is necessary to prohibit the disposal of solid waste other than by use of the Town-designated disposal and recycling site pursuant to rules and regulations now in effect and to be enacted in the future.
As used in this chapter, the following terms shall have the meanings indicated:
DUMP
Includes any land used for the disposal by abandonment, depositing, burying, dumping, burning or any other means of disposal and for whatever purpose, any garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof or waste materials of any kind other than trees, brush, vegetation, earth, gravel, rocks and sand.
PERSON
Includes an individual, an association, a partnership and/or a corporation, municipal or private.
SOLID WASTE
Includes garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof or waste material of any kind other than trees, brush, vegetation, earth, gravel, rocks and sand.
Solid waste shall be disposed of by use of a Town-authorized disposal and recycling site by all persons within the Town, except commercial haulers, to be in accordance with all applicable federal, state and Town laws, rules and regulations.
A. 
No person shall dispose of solid waste other than in accordance with the foregoing § 171-3.
B. 
No person shall establish or use any dump within the Town except such as may be authorized and approved by the Town Board.
C. 
No person shall establish or use within the Town any transfer station except as may be authorized and approved by the Town Board.
Any person violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punished by a fine not to exceed $250 for each such violation or by imprisonment not to exceed 15 days. Each day during which any such violation shall exist shall constitute a separate violation. Each separate violation shall be punishable as set forth herein.
The Town Board, in the name of the Town or any aggrieved person, may maintain a legal or equitable action or proceeding in any court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of any provision of this chapter.
