Public Health Law § 1399, Subdivision 6, requires every employer
to have a written policy on smoking in the workplace.
All governmental buildings and facilities within the Town of Milan are
hereby declared to be smoke-free environments, and all smoking is hereby banned
and prohibited within those buildings and facilities, in accord with the provisions
of New York State Public Health Law.
As used in this chapter, the following terms shall have the meanings
indicated:
SMOKING
The burning of a lighted cigar, pipe, cigarette or any other matter
or substance which contains tobacco.
Employees, officials and the public are encouraged to present any concerns
to the Supervisor of the Town of Milan and may register a complaint with the
Dutchess County enforcement officer.
A copy of this policy shall be posted upon all Town of
Milan bulletin boards and in each separate building in which Town employees
or officials work or the general public congregates.
Employees, officials, or public found smoking within any Town of Milan
governmental building or facility will be considered in violation of this
chapter and may be subject to the penalty prescribed by the Dutchess County
Health Department or the New York State Commissioner of Health.
The Supervisor of the Town of Milan shall be designated an agent to
assist in the enforcement of this policy by notifying employees, officials
or the public who are in violation.
