Any person owning or having the management or
control of any lot or parcel of land in the Town/Village shall keep
and preserve the same clean and inoffensive and free from burdocks,
thistles, sticktights, briers, ragweed and other noxious weeds at
all times and shall prevent the depositing or collecting of any refuse,
rubbish or garbage thereon unless a permit has been obtained therefor.
In case any person shall fail to comply with this section, after five
days' notice by the Building Inspector to do so, the Building Inspector
may cause such lot or parcel of land to be cleaned, and the expense
thereby incurred shall be assessed against such property in the manner
prescribed by law.
No person shall play in or about or interfere
with or tamper with or damage any buildings under construction or
vacant buildings or any personal property therein.

It shall be unlawful for any person, either
as owner, lessee, agent, tenant or otherwise, to throw, cast or deposit,
or cause or permit to run, drop or remain or to be thrown, cast or
deposited, in or upon any vacant lot of land or vacant place, upon
the surface of any lot of land, enclosed or otherwise, or upon any
roof or in any court, yard or open space within the Town/Village of
East Rochester, except at such place or places designated or provided
by the Board of Trustees of the Town/Village of East Rochester, New
York, any waste, leaves, brush, hay, weeds, straw, litter, wastepaper,
boxes, shavings or any filthy, combustible or flammable materials,
rubbish, garbage or dirt whereby a fire hazard, danger or risk is
or may be engendered or injuriously affected or whereby the premises
of another, or the enjoyment of the premises of another, are or may
be injured, damaged, interfered with or prejudiced. Nothing in this
section shall be construed as to prohibit the depositing of manure
upon any private property for the purpose of cultivating the same.

All properties shall comply with the requirements of the Property
Maintenance Code of the New York State Uniform Fire Prevention and
Building Code and Energy Code and the requirements of this chapter.
Where this chapter conflicts with the Property Maintenance Code, whichever
provisions are more restrictive or impose the greater requirements
shall prevail.
