A. 
Creation of office. There is hereby created the office of Borough Attorney, who shall be appointed annually by the Mayor with the advice and consent of the Borough Council, and hold office for one year until his/her successor shall have qualified. The Attorney to be appointed as herein provided shall be duly licensed to practice law in the State of New Jersey.
B. 
Suits and actions. The Attorney shall prosecute or defend any and all suits or actions at law or equity to which the Borough may be a party, or in which it may be interested, or which may be brought against it, or by, any officer of the Borough on behalf of the municipality, or in the capacity of such person as an officer of the Borough when authorized to do so by the Mayor and Council.
C. 
Judgments and foreclosures. It shall be the duty of the Attorney to see to the full enforcement of all judgments or decrees rendered in favor of the Borough, to prosecute to conclusion all specific tax foreclosures which shall be authorized by resolution of the governing body, and to otherwise fulfill the professional responsibility of an attorney in the collection, enforcement and attainment of judgments on its behalf.
D. 
Advice and counsel. The Attorney shall be the legal advisor of the Borough, and shall render legal advice on all legal questions affecting the Borough, whenever requested to do so by any Borough official. Furthermore, the Attorney shall advise and counsel the Borough on all matters of New Jersey law as it pertains to the governmental functions, and otherwise advise the officers, agents and representatives of the Borough of Hamburg, in writing when requested to do so, in the capacity of attorney to client.
E. 
Special assessments. It shall be the duty of the Attorney to see to the completion of all special assessment proceedings, condemnation proceedings or matters involving assessment and tax collections, including County and state tax appeal hearings.
F. 
Ordinances and documents. It shall be the duty of the Attorney to draft or supervise the phraseology of any ordinance and resolution, when requested to so act, and to prepare, modify and draft all contracts, leases, or other legal documents or instrument to which the Borough is a party or for which it has the authority to entertain and adopt when directed to so proceed on behalf of the Borough.
G. 
Appointment and compensation. The Borough Attorney shall be appointed annually by resolution of the governing body pursuant to New Jersey law. The appointment may be with or without public bidding as to the compensation to be paid for the services. All payments for the fees for legal services rendered shall be by submission and approval of appropriate voucher to the governing body setting forth the services rendered and fees due pursuant to the following schedule of compensation hereby adopted: the Attorney shall receive such compensation as may be authorized by resolution duly adopted by the Mayor and Council of the Borough of Hamburg.

There is hereby created the office of Borough Engineer, who shall be appointed annually by the Mayor with the advice and consent of the governing body, and hold office for one year until his/her successor shall have qualified. The Engineer to be appointed as herein provided shall be licensed to practice professional engineering in the State of New Jersey.
B. 
Maps, plats and records. The Borough Engineer shall keep accurate maps, plats and records of all public works, lands or properties authorized to be undertaken by the Engineer during his/her tenure.
C. 
Duties. The Borough Engineer shall advise the Council and Borough officials on all engineering matters referred to him/her, and shall perform such duties as are provided by law or ordinance, and in addition thereto such other duties as from time to time may be imposed upon him/her by the Mayor and Council. He/she shall, from time to time as required by the Mayor and Council, make reports regarding public improvements, repairs of streets, ditches and sidewalks or such other work as the Council may request, and shall make such suggestions to the Mayor and Council regarding the same as in his/her judgment shall be best and proper.
D. 
Appointment and compensation. The Borough Engineer shall be appointed annually by resolution of the governing body pursuant to New Jersey law. The appointment may be with or without public bidding as to the compensation to be paid for the services. All payments for the fees for engineering services rendered shall be by submission and approval of appropriate voucher to the governing body setting forth the services rendered and fees due pursuant to the following schedule of compensation hereby adopted: the Engineer shall receive such compensation as may be authorized by resolution duly adopted by the Mayor and Council of the Borough.

There is hereby created the office of Borough Auditor, who shall be appointed annually by the Mayor with the advice and consent of the governing body, and hold office for one year until his/her successor shall have qualified. The Auditor to be appointed as herein provided shall be a licensed certified public accountant and have been duly certified by the State of New Jersey as a registered municipal accountant.
B. 
Duties. The Borough Auditor shall examine the financial statements of the various funds of the Borough for the year and prepare an annual report of audit as is required by laws of the State of New Jersey. This examination shall be made in accordance with generally accepted accounting standards and in compliance with the audit requirements as prescribed by the Division of Local Government Services, Department of Community Affairs, State of New Jersey, and accordingly include such tests in auditing of records and such other auditing procedures as are necessary and prudent to accomplish a thorough review of all municipal finances to assure efficiency, integrity and accountability regarding all public funds of the Borough.
C. 
Annual audit report. The Borough Auditor shall prepare schedules and information for a fair presentation of the financial statements as required by the Division of Local Services and report to the Division on an annual basis as is required by New Jersey law. The Auditor shall prepare an independent auditor's report directed to the Mayor and Council providing for recommendations, criticisms and explanations on an annual audit, and present the same in booklet form on or before July 1 of each year following the year-end audit.
D. 
Advice and counsel. The Auditor shall advise the Mayor and Council of all matters of fiscal policy, including assistance in areas of grants, loans and other federal and state funding programs, advise and counsel the Mayor and Council on any bonding programs and other prospects of governmental financing as from time to time may be imposed upon the Auditor by the governing body upon request.
E.

This appointment may be with or without public bidding as to the compensation to be paid for the services. All payments for accounting fees shall be by submission and approval of appropriate voucher to the governing body setting forth the services rendered and fees due pursuant to the following schedule of compensation hereby adopted: the Auditor shall receive such compensation as may be authorized by resolution duly adopted by the Mayor and Council of the Borough.

There is hereby created the office of Chief Financial Officer. The Chief Financial Officer shall have all the powers and perform all the duties conferred by N.J.S.A. 40A:9-140.10 et seq.

It is the expressed intention of the governing body of the Borough pursuant to this chapter to establish the positions of Borough Attorney, Borough Engineer, Borough Auditor and Chief Financial Officer by appropriate ordinance and to set forth the compensation to be paid therefor in order to fulfill the requirements necessary to legally create the positions according to law without in any way limiting the common law and statutory responsibilities of the officers to act for and on behalf of the Borough.
