A. 
The following charges and fees for connection and for use of the local sewerage system and the SCMUA sewage treatment plant are hereby fixed and/or prescribed, and the Borough shall charge same to the user and the user shall pay such to the Borough on a quarterly basis. For the purpose of this section, the quarterly periods shall be calendar quarters. There shall be a charge of $197.82 per quarter for equivalent single-family dwelling units (EDU), effective February 1, 2021.
B. 
Where at least one of the owners of a single-family dwelling or multifamily dwelling unit is at least 65 years of age and the premises have been granted a senior citizen real-estate deduction pursuant to N.J.S.A. 54:4-8.41 by the Hamburg Tax Collector, then the charge for an equivalent unit shall be $182.82 per quarter, effective February 1, 2021.
The charges and rents shall draw interest and be a lien upon the premises until paid and the Borough may exercise the remedies for the collection thereof with interest, costs and penalties provided in N.J.S.A. 40:63-8 and as it has by law for the collection of taxes upon real estate. Charges for sewer use shall be a lien upon the premises as provided by statute.
The owner of each premises will be held responsible for the sewer charges of their tenants since the sewer charge is a lien on the property as stated in § 164-65 of this chapter.

A. 
If a bill remains unpaid for a period of 30 days after the billing date, it shall be classed as delinquent and, upon 10 days' notice to the property owner, service may be discontinued. Said written notice shall be mailed by regular mail to the owner of record of the property as shown on the tax assessment records. If service is thus discontinued, it will be restored the next business day after all bills, statutory interest and a service fee of $100 are paid.

B. 
No sewer service shall be discontinued from November 15 to March 15 of any year due to nonpayment of bills. No sewer service shall be discontinued where the bill, not including interest, is less than $100, but interest shall continue to accrue.

No abatement will be made for leaks, or for water wasted by damaged fixtures.

A service connection fee shall be paid prior to any connection being made to the Borough's system and/or prior to the issuance of a certificate of occupancy. The service connection fee shall be determined by the Mayor and Council each year and shall be recomputed at the end of each budget year after a public hearing is held in accordance with the provisions of N.J.S.A. 40A:26A-11.

A. 
In general, each user will receive a charge for sewer service to cover the debt service plus operation, maintenance, and replacement costs of both the SCMUA system and the Borough's sewer system.
B. 
These costs will be divided among the users, and expressed as a fee which is billed to the user, separate from taxes. The method for determining this charge will be based on an equivalent single-family dwelling unit (EDU) system. The unit system will distribute the proportional share of operational costs of the Borough and SCMUA systems among all the users of the system. The unit assignments are shown below:

When multiple users or enterprises exist within a single user, or on a single property, separate unit user charges shall be applied to each applicable type or use contained therein, as set forth in this schedule.
C. 
The Borough reserves the right to modify the number of EDUs assigned to any user, based on actual discharge volumes.

A unit assignment of an equivalent dwelling unit to any property in the Borough of Hamburg shall not be transferable. The foregoing prohibition shall also apply in the event that a particular parcel or premises does not utilize the EDU(s) or discontinues utilizing the EDU(s).
A surcharge may be imposed on a user of the Borough's system when a user's sewage volume, quality, or other characteristics are not in compliance with the Borough or SCMUA rules and regulations, and said noncompliance causes an increase in cost to the Borough and/or SCMUA for managing all sewage and sludges affected by said noncomplying discharge. Such surcharge shall be equal to the increase in cost to the Borough and/or SCMUA for the treatment of all sewage and sludges affected by the noncomplying sewage discharge.
Laboratory analyses will be performed, if deemed necessary, on composite samples of a user's sewage flow to determine its biological and chemical composition. The results of these analyses will be used to determine a user's surcharge, if any. The standard laboratory procedures shall be those found in the latest edition of "Standard Methods for the Examination of Water and Wastewater." The costs of these analyses shall be paid by the user.
In cases where the BOD of the sewage, in the opinion of the Borough, does not represent the true character of the oxygen demand, the Borough reserves the right to use chemical oxygen demand (COD) instead of BOD.
The fee for the closing of a sewer line or lateral to a building shall be equal to the costs incurred by the Borough in the closing of the line.
The fee for reopening any sewer line or lateral to a building shall be equal to $100 plus the costs incurred by the Borough in the reopening of the line.
