A.
Any permanent officer or member of the Police Department
shall be subject to reprimand, reduction of pay, suspension from duty,
reduction in rank or dismissal, fine or removal, according to the
nature or aggravation of his or her offense, for any violation of
the rules, regulations, orders or resolutions governing the Police
Department or for any of the following causes:
(1)
Intoxication.
(2)
Willful disobedience of orders.
(3)
Indecent, profane or harsh language.
(4)
Disrespect to a superior officer or failure to obey
an order or command of a superior officer.
(5)
Unnecessary violence to a prisoner or person under
arrest.
(6)
Absence without leave.
(7)
Sleeping on duty.
(8)
Absence from post of duty without excuse.
(9)
Not properly patrolling his or her beat.
(10)
Refusal to pay debts contracted while in the
Police Department.
(11)
Immorality, indecency or lewdness.
(12)
Incapacity, either mental or physical, lack
of energy or gross ignorance of the laws, rules, regulations and orders
of the Department.
(13)
Frequenting, except on police business, any
gambling house or house of ill fame or visiting, while in uniform
or on duty, except on police business, any tavern or liquor store.
(14)
Conviction of any criminal law.
(15)
For making known any proposed action or movement
of the Police Department or contents of any order, other than to persons
immediately concerned in its execution.
(16)
Conduct unbecoming a gentlemen/women and an
officer.
(17)
Conduct subversive of good order and the discipline
of the Police Department.
(18)
Failure to report a known violation of any law
or ordinance of the Township of Hanover or accepting a bribe or favor
as a consideration either for the performance or nonperformance of
his or her duty.
(19)
Soliciting anyone to intercede with the Chief
of Police or the Township Committee in relation to promotions, changing
of beats, disposition of pending charges or any findings of a trial
before the Township Committee or for refusing to do duty or evading
duty of any kind whenever necessity requires, whether on patrol or
elsewhere and whether in uniform or not.
(20)
Failure to report for duty and work shifts as
assigned.
(21)
Failure to report for duty when notified so
to do by a superior officer either directly or indirectly.
(22)
Failure to report a known violation of any law
or ordinance of the Township to a superior officer.
(23)
Abuse of police cars and/or other equipment.
(24)
Any other just cause as determined by the Township
Committee or as permitted by law.
The Township Committee may, in its discretion,
appoint a hearing officer to conduct disciplinary hearings involving
police officers. The appointed hearing officer shall be such a person
who, in the judgment of the Township Committee, possesses the necessary
training, knowledge and experience to conduct disciplinary hearings
involving police officers. The designated hearing officer shall be
fully authorized to conduct such hearings on behalf of the Township
Committee and, after the conclusion of hearings, shall prepare written
proposed findings of fact and conclusions of law for submission to
the Township Committee. The Township Committee retains full authority
to accept, reject or modify the proposed findings of fact and conclusions
of law of the hearing officer.
The Chief of Police shall have the power to
suspend from duty any member of the Department against whom charges
are brought for violating any of the regulations set forth herein
or any applicable law or regulation governing the operation of the
Township Police Department or the conduct of police officers generally.
Such suspension may be with or without pay as permitted by law and
shall be effective until such time as a final decision is rendered
after hearing.
A.
The Chief of Police shall make recommendations to
the Township Committee in the promulgation of such rules and regulations
concerning the conduct and duties of the officers and personnel, the
kinds of uniform and insignia to be worn by them and such other matters
as may be necessary for the proper regulation of the Police Department.
When the same have been adopted by the Township Committee, they shall
be known as the "Rules and Regulations for the Government of the Police
Department of the Township of Hanover, County of Morris and State
of New Jersey" and shall be binding upon each officer and member of
the Police Department and all special officers and may further make
provisions for the acquisition of such apparatus, equipment and vehicles
as the Township Committee may deem necessary or useful for the Police
Department.
B.
Each member of the Police Department shall be presented
with a printed copy of the Rules and Regulations of the Police Department,
and any neglect or failure by any member of the Police Department
to carry out each and every rule and regulation or order as aforesaid
shall be held to be sufficient cause for dismissal from the Department.
