The Township Committee may, in its discretion,
appoint a hearing officer to conduct disciplinary hearings involving
police officers. The appointed hearing officer shall be such a person
who, in the judgment of the Township Committee, possesses the necessary
training, knowledge and experience to conduct disciplinary hearings
involving police officers. The designated hearing officer shall be
fully authorized to conduct such hearings on behalf of the Township
Committee and, after the conclusion of hearings, shall prepare written
proposed findings of fact and conclusions of law for submission to
the Township Committee. The Township Committee retains full authority
to accept, reject or modify the proposed findings of fact and conclusions
of law of the hearing officer.
The Chief of Police shall have the power to
suspend from duty any member of the Department against whom charges
are brought for violating any of the regulations set forth herein
or any applicable law or regulation governing the operation of the
Township Police Department or the conduct of police officers generally.
Such suspension may be with or without pay as permitted by law and
shall be effective until such time as a final decision is rendered
after hearing.
