As a condition of final site plan approval, any applicant/owner
or developer of property shall also be required to complete and submit
to the Business Administrator/Township Clerk an application to have
New Jersey Motor Vehicle Statutes made applicable to private property,
as specified under the provisions of N.J.S.A. 39:5A-1. The application
form, to be executed by a corporate officer, partner or individual
owner possessing the authority to grant permission, must include a
site plan showing the parking areas, roadways, driveways or paths
to be affected by vehicular traffic. When a project is nearing completion,
and prior to the issuance of a certificate of occupancy by the Construction
Code Official, the Township Engineer shall advise the owner or developer
to file the application as set forth above with the Business Administrator/Township
Clerk.
Upon receipt of the completed and signed application
to have New Jersey Motor Vehicles Statutes made applicable to private
property, the Business Administrator/Township Clerk shall forward
the original application to the New Jersey Department of Transportation's
Bureau of Traffic Engineering and Safety Programs requesting the performance
of an on-site inspection of the property in question for the purpose
of recommending the application of various traffic regulations under
Title 39. Copies of the completed Application shall be filed with
the Chief of Police and the Planning Board and/or Board of Adjustment.
It shall be the responsibility of the Chief of Police and/or his designee to prepare, and periodically update, an inventory of all those ordinances adopted by the Township Committee which pertain to the regulation and enforcement of Title 39 upon public, semipublic or private roadways and other areas used for vehicular traffic. This inventory shall also include a complete listing of all new approved site plan locations and existing private properties on which fire lanes and/or fire zones have been designated and enforceable under N.J.S.A. 40:48-2.46 and the provisions of Chapter 137, Article III, Fire Lanes and Fire Zones. The inventory, and all updates, shall be distributed to all police officers and the Chiefs of the Cedar Knolls and Whippany Fire Departments for reference and information purposes.
The procedures set forth under § 137-35 shall also apply to those owners of existing private properties (not before the Planning Board or Board of Adjustment) wishing to make application for the enforcement of those regulations under Subtitle 1, Title 39, of the New Jersey Revised Statutes pursuant to N.J.S.A. 39:5A-1 and N.J.S.A 40:48-2.46.
