The owner of every existing building or structure and the owner of buildings or structures hereafter to be constructed or acquired, which may be occupied or used by human beings, including but not limited to dwellings and commercial and industrial structures located on a street or road within the area defined or delineated as the "groundwater impact project area" by the New Jersey Department of Environmental Protection, wherein the public water supply system is shown to be extended and available to serve said building or structure and where the property line of a lot containing said building or structure is within 400 feet of said water supply system shall, within 90 days after the date on which the water supply is made available to said building or structure, connect and hook up said building or structure to said water supply system.
If the owner of any house, building or structure referred to in § 420-1 hereof shall fail to permit any connection required by this chapter within the time herein required, the Township may proceed to make such connection or cause the same to be made and assess the cost thereof as a lien against such house, building or structure pursuant to and in accordance with the provisions of N.J.S.A. 40A:31-12.
All privately owned water wells within the groundwater impact or project area shall be dismantled and permanently sealed in accordance with the requirements of N.J.A.C. 7:9-9 within 30 days of the date that centrally supplied water service becomes available; this requirement shall not apply to any privately owned water well within the project area that is devoted exclusively to irrigation for agricultural or horticultural purposes.
Any person, association or corporation who shall fail to comply with this chapter within 90 days after notice by the Clerk of the Township of Independence shall, upon complaint in the Independence Township Municipal Court, be subject to a fine of not more than $500 or imprisonment for a term not to exceed 90 days or both and, in addition, shall be subject to a fine of not more than $10 for each day of delay after the expiration of the 90 days in which the provisions of the notice are not complied with.
This chapter shall become effective upon final passage, following a public hearing to be conducted thereon and publication as required by law.
