It is the decision of the Board of Commissioners of the City of Margate
City that the use and operation of boats on the beaches of the City of Margate
City should be limited and controlled in order to protect the safety, health
and well-being of all citizens using said beaches.
The following definitions shall apply to this chapter:
BOAT
A vessel or watercraft capable of being used as a means of transportation
on water and propelled wholly by sails or muscular power. Specifically excluded
from use upon the beaches are boats or power vessels temporarily or permanently
equipped with machinery for propulsion. All rubber or canvas-type crafts and
surfboards are exempt from this chapter, insomuch as they are regulated by
the Margate City Beach Patrol Regulations. Exempt craft may not be stored
on the beach or street ends.
OPERATE
To navigate or otherwise use a boat.
OWNER
A person other than a lienholder having the property interest in
or title to a boat. The term "owner" includes a person entitled to the use
or possession of the boat.
Every owner of every boat, as defined above, shall be required to obtain
a license from the City of Margate City before bringing or permitting to be
brought or using any boat, as herein defined, on any beach or in the surf
in the City of Margate City.
All boat licenses shall be issued by the City Clerk of the City of Margate
City. There shall be no more than 35 licenses issued. Licenses shall be for
terms of one year, from March 1 to March 1.
License number decals issued by the City of Margate City shall be permanently
painted on or attached to the side of the boat.
The boat owner's license fee hereunder shall be the sum of $100 and
shall be payable in advance.
