The Board of Commissioners of the City of Margate
City finds and determines that it is in the best interest of the City
of Margate City to establish a Construction Code Enforcing Agency
and a Construction Board of Appeals within the City of Margate City.

There is hereby established in the City of Margate City a State
Uniform Construction Code Enforcing Agency, consisting of a Construction
Code Official, Building Subcode Official, Plumbing Subcode Official,
Electrical Subcode Official, Fire Subcode Official and such other
subcode officials for such additional subcodes as the Commissioner
of the Department of Community Affairs, State of New Jersey, shall
hereafter adopt as part of the State Uniform Construction Code.

The Uniform Construction Code fees shall be
as follows:
A.
Plan review fee. Twenty percent of the total permit
fee shall be deemed to be the plan review fee.
B.
Construction permit fees for the building subcode shall be as follows:

(1)
The minimum fee for the building subcode shall be $64.
(4)
For combinations of additions or renovations, the fee shall be computed
separately.
(5)
For renovations and alterations, the fee shall be $30 per $1,000
of the estimated cost of work for the first $50,000 and $23 per $1,000
of the estimated cost of work for the next $50,000 and $19 per $1,000
of the estimated cost of work thereafter.
(6)
For
the unit rate for large, open-volume, single-story spaces in buildings,
such as greenhouses, warehouses, and other agricultural occupancies,
the fee shall be based on the following:
(a)
For additions and new construction: $0.020 per cubic foot of volume.
(b)
For renovation and alterations: $25 per $1,000 of the estimated cost
of work for the first $50,000 and $18 per $1,000 of the estimated
cost of work for the next $50,000 and $14 per $1,000 of the estimated
cost of work thereafter.

For the construction of a sign, the fee shall be $2.50 per square
foot, with a minimum fee of $64.
(9)
For the construction of a pool, there will be flat fee of $195.
(10)
For asphalt paving, the fee shall be $25 per $1,000 of the estimated
cost of the work, with a minimum fee of $64.
(11)
For the installation or construction of a temporary structure,
there shall be a flat fee of $150, plus the cost of all necessary
electrical, plumbing and service connections.
(12)
For the installation of piles that support a building or structure,
the fee shall be $25 per $1,000 of estimated cost of the work, with
a minimum fee of $64. For the installation of piles, the fee shall
be $25 per $1,000 of the estimated cost of the work, with a minimum
fee of $64.
(13)
The fee for changing from one use group to another use group
shall be a flat fee of $150.
(14)
For the moving of a building or a structure from one lot to
another, the fee shall be $25 per $1,000 of the estimated cost of
the footing and foundation installation, plus the cost of all necessary
electrical, plumbing and service connections, with a minimum fee of
$64.
C.
Construction permit fees for the elevator subcode shall be in accordance
with N.J.A.C. 5:23-12.6, Test and Inspection Fees. If the City of
Margate uses a third-party agency to perform inspections, the fee
will be in accordance with the contract with the third-party agency.
The City of Margate shall charge an administrative fee in the amount
of $50.

D.
Construction permit fees for the electrical subcode shall be as follows:
(1)
The minimum fee for the electrical subcode shall be $64.
(a)
The minimum fee for a temporary pole shall be $64.

Dishwasher: $15 each.
(c)
Garbage disposal: $15 each.
(d)
Dryer: $15 each.
(e)
Air-conditioning unit: $15 each.
(f)
Whirlpool spa: $15 each.
(g)
Pool filter motor: $15 each.
(h)
Light standards: $15 each.
(i)
Water heater: $15 each.
(j)
Signs (lighted): $15 each.
(k)
CSST Bonding: $15 each.
(m)
Elevator disconnect: $15 each.

E.
Construction permit fees for the plumbing subcode shall be as follows:
(1)
The minimum fee for the plumbing subcode shall be $64.
(2)
Fixtures:
(a)
Water closet: $15 each.
(b)
Urinal/bidet: $15 each.
(c)
Bathtub: $15 each.
(d)
Lavatory: $15 each.
(e)
Shower: $15 each.
(f)
Floor drain: $15 each.
(g)
Sink: $15 each.
(h)
Dishwasher: $15 each.
(i)
Drinking fountain: $15 each.
(j)
Washing machine: $15 each.
(k)
Hose bibb: $15 each.
(l)
Water heater: $15 each.
(m)
Fuel oil piping: $64 each.
(n)
Gas piping: $64 each.
(o)
Steam boiler: $15 each.
(p)
Hot-water boiler: $15 each.
(q)
Sewer pump: $15 each.
(r)
Interceptor/separator: $15 each.
(s)
Backflow preventer: $91 each.
(t)
Grease trap: $91 each.
(u)
Water-cooled air-conditioning or refrigeration unit: $15 each.

Sewer connection: $91 each.
(w)
Water service: $91 each.
(x)
Active solar system: no charge.
(y)
Condensate drain: $15 each.
(z)
Rain sensor: $15 each.
(3)
For cross connections and backflow preventers that are subject to
testing requiring reinspection every three months, the fee shall be
$45 for each device when they are tested (thrice annually) and $100
for each device when they are broken down and tested (annually).
F.
The construction permit fee for the fire subcode shall be as follows:

In order to provide training, certification and technical support
programs required by the Uniform Construction Code Act and regulations,
the enforcing agency shall collect, in addition to the fees specified
above, a surcharge fee of $0.00371 per cubic foot of volume for new
construction and additions and $1.90 per $1,000 of the cost of alterations
and renovations. These fees shall be remitted quarterly to the Department
of Community Affairs, State of New Jersey.

K.
For the purpose of determining costs, the Construction Official may
require copies of bona fide contracts.
L.
Under I.R.C. § 501(c)(3). The preceding shall apply to
all permits payable on or after January 1, 2002.

In accordance with N.J.S.A. 52:27D-126e no person
shall be charged a construction permit surcharge fee or enforcing
agency fee for any construction, reconstruction, alteration or improvement
designed and undertaken solely to promote accessibility by disabled
persons to an existing public or private structure or any of the facilities
therein. Additionally, a disabled person, or a parent or sibling of
a disabled person, shall not be required to pay any municipal fee
or charge in order to secure a construction permit for any construction,
reconstruction, alteration or improvement which promotes accessibility
to his own living unit.
The Construction Code Official shall prepare
and submit to Margate City, biannually, a report recommending a fee
schedule based on the operating expenses of the Agency and any other
expenses of the municipality fairly attributable to the enforcement
of the State Uniform Construction Code Act.[1]

This chapter and the Construction Code Enforcing
Agency and regional Construction Board of Appeals created hereunder
shall be subject to such rules and regulations as may, from time to
time, be lawfully promulgated by appropriate agencies of the State
of New Jersey.

Municipal subcode permit fees (excluding elevators)
shall be waived for all charitable organizations recognized under
I.R.C. § 501(c)(3). The preceding shall apply to all permits
payable on or after January 1, 2002.
