The Select Board shall have the authority to adopt, and from time to time to amend, such comprehensive regulations for the use of the waterways of the Town of Fairhaven as may be recommended to them by the Harbormaster.
Except as otherwise provided by law, the penalty for a violation of the waterways regulations enacted hereunder shall be $300. Each day that such violation continues shall be deemed a separate violation. The monetary penalty set forth herein shall be in addition to any applicable regulatory penalty, including, but not limited to, the suspension or revocation of any license or permit, or the disqualification of the violator from obtaining any license or permit.
Fines assessed hereunder may be recovered by indictment, or on complaint to the District Court, or by noncriminal disposition in accordance with MGL c. 40, § 21D.
