Each food-service establishment shall:
A. 
Have on its premises, while food is being served and consumed, at least one employee on each shift trained and certified in choke-saver (Heimlich's maneuver) procedures certified by an instructor approved by the Board of Health. Recertification shall be annually, upon expiration.
B. 
Make adequate provisions for insurance to cover employees trained in rendering assistance.
A. 
Any person or persons who shall fail to comply with any order issued pursuant to the provisions of this article shall, upon the discretion of the Board of Health, under the authority of 105 CMR 400.700(B), have the food-service establishment permit suspended or revoked and/or be fined, upon conviction, not more than $100 for the first offense and not more than $500 for subsequent offenses unless a different penalty is set by statute [105 CMR 590.062(A)].
B. 
Any person who fails to comply with any order issued pursuant to the provisions of this article shall, upon conviction, be fined not more than $100 for the first offense and not more than $500 for a subsequent offense. Each day's failure to comply with an order shall constitute a separate offense [105 CMR 590.062(B)].
