Trash collection unit vehicle owners shall register each and every vehicle
employed specifically for residential trash collection in the Town of Franklin
with the Franklin Board of Health.
A proper application form shall be submitted to the Board of Health
and, upon inspection of carrier vehicles and approval of such, a permit will
be issued upon a fee payment of $50 for each vehicle, renewable annually on
January 1.
Each and every vehicle shall bear the firm's or business' name and the
telephone number on both sides of the unit with letters and numbers no less
than six inches in height, plainly visible on both sides of the vehicle.
Each and every licensed vehicle shall conspicuously display within the
unit the permit issued by the Board of Health. Permit numbers shall correspond
with the outside vehicle identification number.

No solid waste shall be collected on days observed as holidays by Wheelabrator
Millbury Incinerator in Millbury, Massachusetts, except for those alternative
trash haulers granted a permit from the Franklin Board of Health who collect
solid waste from units granted an alternative hauler exemption from the Town
of Franklin.
The following shall be excluded from curbside pickup: any item which
cannot reasonably be lifted by two men into a collection vehicle; any item
of size or dimension which cannot be compacted by a collection vehicle; all
hazardous wastes; fifty-five-gallon drums, whether empty or full; demolition
materials; tree trunks or stumps; cast metal: motor vehicle engine parts;
cement, rock or stone or gravel; sand or dirt; manure; any debris generated
by a commercial activity; and all toxic, radioactive, pathological or biological
wastes.
The permit holder shall take all proper precautions to protect all public
and private property from unnecessary interference, injury or damage. If any
property, excluding trash containers, is damaged through the fault of the
permit holder or its employees or agents, it shall promptly repair or replace
the same at its own expense.
At its own expense, the permit holder shall be solely responsible for
transportation to a suitable alternate disposal site and for payment of all
associated fees in the event that Wheelabrator Millbury Incinerator refuses
to accept waste delivered to the facility by the permit holder for any reasons
set forth in Section III.1 of the Waste Supply Agreement.
The permit holder shall maintain a separate log book for each vehicle
which it operates for the purpose of collecting trash within the Town. Each
log book shall contain daily logs of the street location on each hour of operation
and each of the four odometer readings taken at the point of origin, the beginning
of each collection route, the end of each collection route and the final daily
destination. Upon request, the permit holder shall provide copies to the Town
of each vehicle's daily logs for the preceding month.
Permit holders shall promptly investigate all service complaints and
provide a telephone report to the designated Town office of all steps taken
to respond to each service complaint. Permit holders shall maintain a service
complaint log and shall provide copies from such log to the Town upon request.
If any section, paragraph, sentence, clause or phrase of the foregoing
rules or regulations shall be decided invalid for any reason whatsoever, such
decision shall not affect the remaining portion of these regulations, which
shall remain in full force and effect; and to this end the provisions of these
regulations are hereby declared severable.
Any variance or other modification authorized to be made by this regulation
may be subject to such qualifications, revocation, suspension or expiration
as the Board of Health expresses in its grant. A variance or other modification
authorized to be made by this regulation may be otherwise revoked, modified
or suspended, in whole or in part, only after the holder thereof has been
given an opportunity to be heard.
This regulation shall supersede any and all previous rules and regulations
relative to residential trash collection adopted by this Board and shall become
effective upon publication in newspapers circulated in the Franklin area.
Penalties for violation of this regulation shall be in accordance with MGL c. 111, §§ 187 and 188 and the Code of the Town of Franklin, §
151-8, and the suspension or revocation of permit or any other penalty clauses adopted by this Board.
