No person being the owner or occupant of any land or premises within the Town shall use or permit the use of said land or premises as a mobile home park without obtaining therefor a permit as herein provided, unless otherwise provided for in this chapter.
A. 
Application for an initial annual mobile home park license shall be filed with the Town of Geneseo Planning Board. The application shall be in writing, signed by the applicant, and shall include the following:
(1) 
The name and address of the applicant.
(2) 
The location and legal description of the mobile home park.
(3) 
A complete plan of the park in triplicate. This plan shall conform to the requirements of the Town as set forth herein.
(4) 
Plans and specifications of all buildings, improvements and facilities constructed or to be constructed within the park.
(5) 
Such further information as may be requested by the Planning Board to enable it to determine if the proposed park will comply with legal requirements.
(6) 
Evidence of approval by the New York State Department of Health and/or Livingston County Health Department.
B. 
The application and all accompanying plans and specifications shall be filed in triplicate. The Zoning Enforcement Officer shall investigate the applicant and inspect the application and the proposed plans and specifications. If the proposed mobile home park will, when constructed or altered in accordance with such plans and specifications, be in compliance with all provisions of this chapter and all other applicable ordinances and statutes, the Zoning Enforcement Officer, with the approval of the Town Planning Board, shall approve the application. Upon completion of the park according to plans, the Town Clerk shall issue the license, and the licensee shall file one copy of the approved plan with the County Clerk and one copy with the Town Clerk.

C. 
Upon application in writing by a licensee for renewal of an annual license and upon payment of the annual license fee, the Zoning Enforcement Officer, upon recommendation of the Town Planning Board, shall issue a certificate authorizing the Town Clerk to renew such license for another year. The application must be supported with current evidence of approval by the Livingston County Department of Health.

The application and permit filing fee shall be as set forth from time to time by resolution of the Town Board. Each additional occupied trailer site will require an inspection fee. The annual park license renewal fee shall be as set forth from time to time by resolution of the Town Board.
A. 
It shall be the duty of each licensee and permit holder to keep a register containing a record of all mobile home owners and occupants located within the park. The register shall contain the following information:
(1) 
The name and legal address of all occupants.
(2) 
The name and address of the owner of each mobile home.
(3) 
The make, type, model, year and license number of each mobile home, as well as the registration number of each mobile home and the state and year in which registered.
(4) 
The date of arrival and departure of each mobile home.
(5) 
Forwarding address of each occupant.
B. 
The park owner or his agent shall keep the register available for inspection at all times by law enforcement officers, public health officials and other officials whose duties necessitate acquisition of the information contained in the register. The register record for each occupant registered shall not be destroyed for a period of three years following the date of departure of the registrant from the park.
A. 
All mobile homes are to conform to all New York State laws and regulations.
B. 
Individual mobile home transfers will require approval and inspection by the Zoning Enforcement Officer and the payment of an original inspection fee as set forth from time to time by resolution of the Town Board.

An initial inspection shall be required by the Zoning Enforcement Officer to ensure that all requirements have been complied with. Thereafter, the Zoning Enforcement Officer shall have the right at any reasonable time to enter any mobile home park to inspect the records required to be maintained in any mobile home park. Upon inspection, if it is found that any person has violated any provision of this chapter, the Town Board shall have the right to revoke and/or suspend any permit issued pursuant to this chapter and order the removal of the mobile home or the cessation of the mobile home park operations, as the case may be, after 10 days' written notice of such violation directed to the owner of the land and premises affected and to the occupant of the mobile home or the operator of the mobile home park, as the case may be, and after a hearing before the Town Board held not less than five days after notice of such hearing.

Any person violating any provisions of this chapter who shall violate or fail to comply with any order or regulation made hereunder, or who shall establish or conduct the business of a mobile home park or use, park or occupy a mobile home or mobile homes or permit the same to be used, parked or occupied in violation of this chapter, or who shall violate any permit or certificate of occupancy issued hereunder, or who shall continue work upon any mobile home park, mobile home or mobile home site after service of notice in writing from the Zoning Enforcement Officer of the Town of Geneseo to desist therefrom, shall forfeit and pay a penalty not to exceed $250 or be imprisoned for a term not to exceed 15 days, or both, for each offense. Each week's continued violation shall constitute a separate, additional violation. Each mobile home violating the provisions of this chapter shall constitute a separate, additional violation. Service of a notice hereunder shall be sufficient if directed to the owner or operator, agent of the owner or operator or contractor employed by the owner or operator and left at the last known residence or place of business of such owner or operator and left at the last known residence or place of business of such owner or operator if within the Town of Geneseo; and if no such residence or place of business can be found, then the notice shall be served by posting the same in a conspicuous place on the premises which are the subject of the violation.
