The Borough of Coudersport shall not accept
any proposed lands for dedication as a public street or public road
of the Borough of Coudersport until all individuals who have any interest
in the land execute and deliver to the Borough of Coudersport deed
or deeds, right-of-way agreement or right-of-way agreements, deeds
of easement or easements in such form as is satisfactory to the Coudersport
Borough Council. Such instrument shall define that which is the subject
matter of the conveyance and give a precise metes and bounds description
of that interest which is being conveyed duly executed by all such
owners of any such interest and properly acknowledged so as to be
suitable for recording in the Register and Recorder's Office of Potter
County, Pennsylvania.
Before any such land is accepted as a public
street or public road by the Borough Council of the Borough of Coudersport,
the said lands shall be first improved so as to meet the criteria,
requirements, standards and specifications as are herein set forth.
It shall be the duty of the property owners
who are offering said lands for dedication to the Borough of Coudersport
as a public street to have the said lands improved at the proper owners'
expense so as to come into compliance with the requirements of this
article before the Borough of Coudersport shall be required to consider
for acceptance the said proposed street as a public street pursuant
to applicable law.
The following standards shall be considered
the general standards which any such proposed street or road must
meet prior to being considered for acceptance as a public street or
road of the Borough of Coudersport:
A. With respect to any earth work performed, with respect to any changes in existing contours, where any existing trees, shrubs or other natural vegetative cover has been or will be removed in order to bring the road into compliance with that set forth in this article, the landowner(s) shall comply with Chapter
370, Stormwater Management and shall further comply with applicable law relating to erosion and sedimentation control plans as is administered by the Soil Conservation District.
B. The landowner(s) shall comply with Chapter
188, Floodplain Management.
With respect to any such proposed street or
road, the said proposed street or road shall conform to the following
street and driveway design standards:
A. The street shall be required to connect to an existing
public road or public street of the Borough of Coudersport. It shall
also be deemed sufficient to comply with this section if the proposed
street or road connects to a public state street or road as is actively
maintained by the Commonwealth of Pennsylvania, Department of Transportation.
This shall not include such things as forestry roads which, for example,
are maintained and operated under the authority of the Commonwealth
of Pennsylvania, Department of Forestry.
B. The owner or owners shall have the proposed street
or road marked with road signs which name and identify the road or
street being proposed. Such name shall not conflict with the names
of existing roads and streets within the Borough of Coudersport.
C. All such streets and roads shall be designed and built
for a twenty-year service life. A twenty-year service life shall mean
that the proposed street will not need to be improved or undergo anything
which would constitute a structural capital improvement to the road
for a span of 20 years and that it is built and designed in such a
manner so as to only require that which is customarily known as routine
road maintenance.
D. The street or road must be structurally designed to
support all anticipated loading without significant loss of the designed
service life of the street. Unless otherwise expressly provided for
herein, all proposed streets must be designed to withstand as a minimum
a twenty-ton capacity.
E. Curbing shall be required on all streets and roads
having a grading of 4% or more. Further, curbing shall also be required
where, in the opinion of the Borough Engineer, a serious erosion problem
may exist. Where curbing is so required, the construction and design
of the same shall comply with the specifications and standards set
forth in the various drawings which are collectively incorporated
herein as Exhibit A.
F. If curbing is not required, berms shall be eight feet
in width and paved.
G. Horizontal curves shall be provided where proposed
street center lines are deflected by 5° or more. Straight portions
of the proposed street must be tangent to the beginning and end of
the horizontal curves.
H. Vertical curves shall be used for all changes in grade
of greater than 1%. The minimum length of any vertical curve is 100
feet.
I. All features of the geometric design of the proposed
street or road that are not specified below shall be designed for
a design speed of 25 miles per hour.
J. The street design criteria shall meet the following
standards:
(3) Horizontal curvature: minimum center line radius of
150 feet.
(4) Minimum tangent length between reverse curbs: 50 feet.
(5) Stopping sight distances: 175 feet minimum.
(6) Maximum grade within 50 feet of intersection: 5%.
K. An unobstructed sixteen-foot wide moving lane with
a minimum outside turning radius of 50 feet shall be provided at the
terminus of every permanent cul-de-sac. A cul-de-sac street shall
not have a length in excess of 1/2 mile.
L. Half streets are prohibited. The full right-of-way
and cart way width of a street shall always be provided. A half street
is defined as any proposed street which would be proposing a cartway
or right-of-way less than that which is required by this article.
M. All intersections shall comply with the following
criteria which shall be interpreted in light of and in conjunction
with Exhibit B.
(1) Corner sight distance (also known as clear sight triangle).
Whenever a proposed street intersects with an existing or another
proposed street, the owner or owners shall designate which street
shall be made a stop street with the requirement that the street which
is contemplated to have the less traffic intensity will be the stop
street. The stop street in such circumstances (i.e., two or more proposed
streets) or the proposed street where it is intersecting an existing
Borough street shall be designed to provide a minimum corner sight
distance as specified in said Exhibit B:
(a)
Y will equal corner sight distance, which distance
will be the sum of the distance when one measures from point A to
C together with the distance when one measures from point C to D.
(b)
B equals eye level from a car stopped at the
intersection on the road of less traffic intensity (proposed road).
For this article, B is situated 3.75 feet above the existing Borough
road or the higher intensity traffic road.
(c)
A and D equals a 4.5 feet above the center line
of the existing Borough road or the higher traffic intensity road.
(d)
C equals approximate length of intersection.
(2) With respect to the above criteria and with respect
to the drawing set forth in Exhibit B, the proposed road shall comply with the following requirements:
(a)
Y shall equal a minimum of 250 feet.
(b)
The entire area of the clear site triangle,
described by points A, B and C above, shall be designed to accommodate
an unobstructed view across it from point B to all points 4 1/2
feet above the roadway along the center line from point A to point
D.
(c)
Minimum curb or edge of pavement radius shall
be 15 feet.
(d)
Proposed streets which intersect opposite sides
of another street (either existing or proposed) shall be laid out
to intersect directly opposite each other.
(e)
Minimum spacing between intersections measured
from center line to centerline shall, at a minimum, have a spacing
distance of 125 feet.
(f)
Cart ways shall intersect at a 90° angle
for a minimum of 50 feet in each direction from the intersection.
The minimum right-of-way width which shall be
deeded or conveyed to the Borough shall be 66 feet.
In unusual circumstances, such as where trees
may, due to the topology, keep the area shaded and thus subject to
ice conditions, the Borough may require a right-of-way width of 100
feet.
Driveways shall be permitted onto the proposed
street provided that the driveway complies with the requirements which
would be imposed upon the driveway in order to obtain a highway occupancy
permit from the Pennsylvania Department of Transportation for a driveway
onto a highway maintained and operated by the Commonwealth of Pennsylvania,
Department of Transportation.
Where driveways are permitted, the following
standards shall apply to the driveway apron at the edge of the cartway.
A. Minimum curb cut or driveway width at the cartway
edge: 10 feet.
B. Maximum curb cut or driveway width at the cartway
edge: 20 feet.
The owner or owners shall install all necessary
roadway signs including speed signs, stop signs and other signs as
may be reasonably required given the design of the street. Such signs
shall comply with applicable state standards including those set forth
in the Pennsylvania Code.
All proposed streets shall conform to the following
minimum construction standards and specifications:
A. With respect to the first page of Exhibit A, that which is shown therein as Item 1 of said exhibit
shall have ID-2 wearing course of a minimum of 1 1/2 inches.
B. With respect to Item 2 as shown as the first page
of said Exhibit A, there shall be bituminous concrete base course
of a minimum of four inches.
C. With respect to that shown on the first page of said
Exhibit A as Item 3, the requirement shall be 2A stone subbase with
a minimum of five inches.
D. With respect to that shown as Item 4 on the first
page of said Exhibit A, the cartway width shall be a minimum of 24
feet.
E. If the proposed road is not curbed then there shall,
in addition, be required a parking lane width of eight feet.
F. If the proposed street or road is not curbed then
there shall be required a shoulder width a minimum of eight feet.
G. With respect to Item 6 as appears on the first page
of said Exhibit A, the pavement cross slope shall have as a minimum
2% and a maximum of 4 1/2%.
With respect to the design and construction
of any such proposed street or road, the design standards as set forth
in Exhibits A and B of this article are incorporated herein by reference thereto
and the owner or owners shall comply with the same prior to the Borough
accepting offer of dedication of the proposed street or road.
Prior to acceptance of the offer of dedication
to the Borough, a Borough representative or Borough Engineer shall
review the completed constructed proposed street or road to verify
that the construction standards set forth herein have been met. To
the extent that the construction work in progress will, in essence,
cover up or otherwise render unobservable that which is required,
the owner or owners, prior to such phase of construction, shall give
the Borough three business days notice prior to such construction
taking place so that a Borough representative or Borough Engineer
can observe the construction to make sure that that phase of the construction
has, in fact, been done in compliance with that required by this article.
All proposed streets and roads shall be paved
and shall comply with the paving requirements set forth in this article.
All proposed streets and roads shall have suitable
guide rails installed by the owner or owners prior to acceptance of
the dedication where appropriate or where needed. Such guide rails
shall be required and shall be deemed needed where there is a vertical
drop of two feet or more once one leaves the paved portion of the
proposed road or street (any pavement including that attached to any
shoulder, etc.) and where the vertical drop of two feet occurs when
one moves perpendicular from the edge of the pavement a distance of
10 feet.
All proposed streets and roads shall be properly
designed to convey stormwater. The minimum diameter of sluices shall
be 15 inches. The minimum requirements for placement of sluice pipes
along the roadway is as follows:

The owner or owners shall provide the Borough
with a performance bond or agreement guaranteeing the performance
of all aspects of the newly constructed road or street and appurtenances
thereto for a period of two years from the date of acceptance of the
road dedication. The Borough will not accept any responsibility for
the maintenance of the road, drainage facilities or appurtenances
until the same has been officially accepted by ordinance.
No statement, action or declaration by the Borough
Council of the Borough of Coudersport or any officer or employee affiliated
therewith shall in any manner be construed as a waiver of the requirements
herein set forth and these requirements must be met prior to the Borough
of Coudersport accepting dedication of any road or street.
