As used in this chapter, the following words
and terms shall have the following meanings:
CONSERVATION AREA
Any place or area in the Village/Town of Mount Kisco identified
as a conservation area on the map and schedule annexed to this chapter, which map and schedule may be amended from time to time,
by resolution of the Board of Trustees of the Village/Town of Mount
Kisco. The term "conservation area" shall include any lake, pond,
pool, river, brook or other body or stream of water located in the
conservation area.
PERSON
Any individual, firm or corporation and all other entities
of any kind capable of being sued.
VILLAGE
The Village/Town of Mount Kisco.
Conservation areas of the village shall be open
to the public from dawn to dusk only. No person shall enter upon a
conservation area at any other time except for emergency purposes.
No person shall disturb any land in a conservation
area or take up, remove in any manner, disturb, cut or in any way
injure any tree, shrub, plant, grass, soil, sod, compost, gravel or
any other property in a conservation area, except by direction of
the Village Manager or his/her designated agent. No fallen trees or
branches shall be cut or removed except by direction of the Village
Manager or his/her designated agent
No person shall cut, break, remove, destroy
or in any way injure any fence, post, ailing, chain, sign, signpost,
tree guard, lamp, lamppost, bridge structure or any other property
in any conservation area, except by direction of the Village Manager
or his/her designated agent.
No person shall hunt, chase, shoot, trap, catch,
molest, wound, discharge, throw missiles at, or disturb any living
creature or the nest or eggs of any amphibian, reptile or bird in
any conservation area.
No person shall make, cause or allow any fire
to be set in any part of any conservation area. No person shall smoke
a cigarette, cigar, pipe or other such material in any conservation
area.
No person shall throw, place, drop, excrete,
discharge or leave in any conservation area any garbage, organic refuse,
offal, urine, fecal or other offensive matter, ashes, cinders, stone,
dirt, filth, rubbish, grass clippings, leaves, paper, pasteboard,
wood, metal, fruits, vegetables or other foodstuffs, vehicles or any
vehicle parts, any manufacturing, trade or household waste or any
other substance or material of any nature whatsoever.
No person shall, in any conservation area:
A. Wade or bathe in or enter in or upon the waters.
B. Place or enter or operate any boat, raft, float or
similar object in or upon the waters.
C. Skate, ski, sled, toboggan or engage in any other
winter sport.
D. Throw, cast, catch, kick or strike with any implement
any baseball, golf ball, football, soccer ball or other object
F. Engage in any other sport or game.
No person shall camp, bivouac, pitch tent or
maintain a shelter in any conservation area, nor shall anyone picnic
or consume food or beverages in any conservation area.
No person shall tie any animal to any tree,
plant or shrub in any conservation area or, having charge of any animal,
allow or cause it to injure any tree, plant or shrub.
No person shall, in any conservation area:
A. Engage in fighting or assaults upon any person.
B. Engage in a course of conduct or commit acts that
unreasonably alarm or seriously annoy another person.
C. Engage in any form of sexual activity.
D. Engage in a course of conduct or commit acts that
endanger the safety of another person.
E. Do any obscene or indecent act.
F. Throw stones or missiles.
G. Beg or publicly solicit subscriptions or contributions.
I. Play cards or other games of chance or use or operate
any gaming table or instruments.
J. Climb upon any tree, building, wall, fence, shelter,
seat sign, pole or other construction.
K. Fire or carry any firearms, except for a police officer
or peace officer while on duty.
L. Fire or have in one's possession any firecrackers,
torpedo or fireworks.
M. Do any act tending to breach the public peace.
N. Carry on any commercial activity.
No person shall operate, drive, ride, propel
or park in any conservation area any bicycle, motorcycle, motor-tricycle,
scooter, roller skates, skateboard, roller blades, automobile or other
vehicle of any nature other than baby carriages, wheelchairs and similar
vehicles designed exclusively for the transportation of infants and
of disabled persons. Nothing in this section shall prevent the operation
of fire-fighting equipment, ambulances, police vehicles or other equipment
operated by authorized personnel under the direction of the Village
Manager.
No person shall post, affix, place or leave
any bill, placard, notice or other paper in or upon any structure,
tree, fence, post, railing, bench, rock, article or thing within any
conservation area nor paint, write, mark, draw or affix with any substance
or material any advertisement, notice of exhortation or any other
writing, drawing or making of any kind, and no person shall distribute,
hand out or cast about any card, circular, pamphlet or other printed
matter or other property or material of any nature within any conservation
area.

Any person violating any provision of this chapter shall be punishable as provided in §
1-17B of this Code.
