GENERAL REFERENCES

A. Pursuant to the powers conferred upon the Village
Board of Trustees under § 1640-i of the New York State Vehicle
and Traffic Law, the Village Board of Trustees finds and declares
that many residential areas in the Village of Mount Kisco suffer from
inadequate parking due to the parking of vehicles owned by non-area
residents. Nonresidents who park in such areas include commuters who
utilize the MTA railroad as well as employees and patrons of businesses
located in commercial areas abutting the residential zones. The Village
Board further finds that the lack of parking for residents of certain
areas in the Village has resulted in traffic hazards, congestion and
air and noise pollution. In addition, such lack of parking poses a
hazard to residents and other pedestrians in such areas.
B. The Board of Trustees further finds that a residential
parking permit system within such area will reduce such hazards and
will reduce pollution levels as well. The Board of Trustees, therefore,
hereby declares the necessity of adopting a residential parking permit
system.
As used in this chapter, the following terms
shall have the meanings indicated:
AREA RESIDENT
The residential owner or owners or residential tenant or
tenants of or in a dwelling whose mailing address fronts upon a residential
parking permit area.
RESIDENT PARKING PERMIT
A decal, sticker or tag issued by the Village Clerk or designee
to an area resident to be affixed to the residents automobile.
The following residential parking permit areas
are hereby established:

A. Resident parking permits shall be placed on the rear
windshield and are not transferable.
B. Area residents may be issued a resident parking permit
upon submission to the Village Clerk of at least the following proof:
a valid vehicle registration showing place of residence and a signed
affidavit or application form as prepared by the Village Clerk that
said applicant does in fact reside in the parking permit area.
C. No area resident shall give or sell a permit to another
person or otherwise allow it to be placed on a vehicle other than
the vehicles listed on the permit application.
D. The fee for the parking permit shall be set forth
by the Village Manager and be valid for one year from the date of
issuance. Said permit must be renewed annually.
E. Area residents residing in the parking permit area defined in §
88-3A shall be entitled to no more than two permits per dwelling.
A. Motor vehicles registered pursuant to § 404-a
of the Vehicle and Traffic Law shall be exempt from any permit requirement.
B. The times of the day and the days of the week during which permit requirements shall be in effect are 6:00 a.m. to 10:00 p.m. Monday through Saturday for the area described in §
88-3A.
C. Signs indicating parking by permit only shall not
be posted in an area of not less than 20% of all spaces within the
entire permit area.
D. Short-term parking of not less than 90 minutes in
duration shall be provided in such area.
E. No parking permit shall be required on streets or
portions of streets where the adjacent properties are zoned for commercial/retail
use.
Any person committing an offense against any provision of this chapter shall be punishable as provided in §
1-17C of the Code.
