The Board of Trustees of the Village/Town of Mount Kisco in the County of Westchester, New York, after a public hearing duly held pursuant to law and after due deliberation, finds as follows: A proper concern for the health and welfare of those who live or work in Mount Kisco, as well as neighboring communities, requires prompt and decisive action on the part of the Village/Town of Mount Kisco during any water emergency.
A. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Construed herein as an individual, partnership, corporation or other such legal entity.
B. 
Word usage. Pronouns in the masculine shall be construed to include those in the feminine and those in the singular to include those in the plural.
A. 
When the Village Engineer, Water Department or other entity charged with the supervision of the Mount Kisco water system presents a report indicating that conditions exist which may prevent the village/town from providing a supply of water adequate to meet the needs of the village/town, the Mayor of the Village/Town of Mount Kisco may declare a water emergency. Said report shall specifically state the conditions then existing and the probable impact of same, if emergency measures are not implemented.
B. 
Upon receipt of a similar such report indicating that emergency measures are no longer required in order to maintain adequate water service, the Mayor shall declare the water emergency to be no longer in existence.
A. 
Upon declaration of a water emergency by the Mayor of the Village/Town of Mount Kisco and during the extent of such emergency, the Manager of the Village/Town of Mount Kisco is hereby empowered to promulgate such water usage regulations as he deems necessary for the proper conservation of water. Such regulations shall be published in the official newspaper and prominently posted in at least six public locations throughout the village/town.
B. 
A violation of any such regulation constitutes a violation of this chapter.
C. 
The Manager is further authorized to issue or cause to be issued appearance tickets for violation of any such regulations.[1]

D. 
Within 20 days of the promulgation of such a regulation, the Board of Trustees may modify or rescind said regulation, in total or in part.

Any person committing an offense against any provision of this chapter shall be punishable as provided in § 1-17B of this Code.
