Upon the filing of the notice of appeal, together with the requisite copies thereof, the Secretary shall file the original thereof with the records of the Board, to be open to public inspection, and shall mail or deliver a copy thereof to each member of the Board and the Village Attorney. When the filing of the copies of any exhibit or annexation has been waived pursuant to § A113-7 hereof, there shall be distributed, in lieu thereof, the summary or description required, and one copy of such summary or description shall be retained with the original records of the Board.
The Secretary of the Board shall advise the appellant or his attorney or agent of the date on which such appeal will be heard and shall forthwith send, to each member of the Board, the Village Attorney and the officer from whose ruling or decision the appeal is being taken, the date of such hearing.
The appellant shall cause a notice of such hearing to be published, at least 15 days prior to the date of hearing, in the duly designated official newspaper of the Village of Mount Kisco (or, if no newspaper is so designated, then in a newspaper of general circulation in such village or in the towns or county in which such village or part thereof is located), shall cause a copy of such notice to be posted in the office of the Village Clerk and shall serve a copy thereof by mail upon the Mayor of the Village of Mount Kisco, on the officer from whose ruling or decision the appeal is taken, on the Chairman of the Planning Board of the Village of Mount Kisco and on each member of the Board, all at least 10 days before the date of such hearing or such longer time as may specifically be prescribed by any other statute, rule or ordinance. In the event that the notice of appeal requests that a variance, permit or special permit be granted, then, in addition, such notice of hearing shall also be served by mail, at least 10 days before the date of such hearing, on each person owning or being the agent of the person owning real property whose name and address is required to be set forth in the plot plan annexed to the notice of appeal, pursuant to § A113-8 hereof, as such owner or agent is shown on the Tax Map of the Village of Mount Kisco and, in accordance with § 239-m of the General Municipal Law, affected adjoining municipalities.
Any notice given pursuant to § A113-12 hereof shall, in addition to any other relevant information, contain the following:
A. 
The nature of the appeal, including the Code of Mount Kisco ordinance number and section and whether a variance, permit or special permit is sought and the nature thereof.
B. 
A brief summary of the ruling or decision appealed from and the name or title of the officer who made such ruling or decision.
C. 
A brief description of the property affected, stating the section, lot and block as shown on the Tax Map of the Village of Mount Kisco, giving the street and house number or distance from the nearest intersecting streets.
D. 
The date, time and place of the hearing.
E. 
The name and address of the appellant and the name and address of his attorney, if any, and the interest of the applicant in the property affected.
In any proceeding before the Board, any person may, but need not, appear by agent or attorney and whenever any party does appear by agent or attorney, any notice required to be given, pursuant to these rules, to such party may thereafter be given to his agent or attorney.
