This Part 2 shall be known as the "Environmental Quality and Coastal Consistency Review Law."
The purpose of this Part 2 is to provide for the environmental quality and coastal consistency review of actions within the Village of Head-of-the-Harbor, thereby incorporating environmental and coastal zone management considerations in planning and decision-making processes, and to extend the planning ability of the village provided in Local Law No. 1 of 1974 (Zoning Law)[1] and other local laws and amendments thereto.

This Part 2 is adopted under authority of the Municipal Home Rule Law, the New York State Environmental Conservation Law and Article 42 of the New York State Executive Law. Pursuant to Article IX, Section 1, of the New York State Constitution and Article 5-G of the General Municipal Law, the Joint Village Coastal Management Commission shall have the authority to carry out the functions of consistency review within the Village of Head-of-the-Harbor provided for in this Part 2.
A. 
Unless the context shall otherwise require, the terms, phrases, words and their derivatives used in this Part 2 shall have the same meanings as those defined in the New York State Environmental Conservation Law and Part 617 of the New York State Code of Rules and Regulations.
B. 
As used in this Part 2, the following terms shall have the meanings indicated:
DIRECT ACTION
An action of the type described in § 81-14D or E of this Part 2.
FARMLAND
Land which has been in agricultural use within five years of the date of the action being proposed.
JOINT VILLAGE COASTAL MANAGEMENT COMMISSION
The Joint Village Commission defined in the LWRP and created, for Head-of-the-Harbor, by resolution of the Board of Trustees December 17, 1988.
LWRP
The Local Waterfront Revitalization Program prepared and undertaken jointly by the Villages of Head-of-the-Harbor and Nissequogue, as approved by the Secretary of State and available in the Village Office.
NYCRR 617
Part 617 of Title 6 of the New York State Code of Rules and Regulations (information on "NYCRR 617" is available in the Village Office).
RESPONSIBLE AGENCY
An approval- or permit-granting village agency acting under this Part 2 in making a finding as to environmental effect and/or consistency with the LWRP of a proposed action; in the former case the "responsible agency" will also usually be the SEQRA lead agency (see NYCRR 617).
SEQRA
The New York State Environmental Quality Review Act (Article 8 of the New York State Environmental Conservation Law).
SIGNIFICANT COASTAL FISH OR WILDLIFE HABITAT

VILLAGE
The Village of Head-of-the-Harbor.
