[HISTORY: Adopted by the Board of Trustees

Notwithstanding any provisions of the Uniform
District Court Act and/or the Uniform Justice Court Act, the following
officials, officers, employees and personnel of the Incorporated Village
of Valley Stream shall have the power to issue and serve, within the
Village of Valley Stream, appearance tickets in cases arising in connection
with the performance of their duties. Such services shall have the
same force and effect as if served by a peace officer, without their
being peace officers.
A.
Building Inspector or authorized agent.
B.
Fire Inspector or authorized agent.
C.
Parking Violations Officer or authorized agent.
D.
Appearance Ticket Officers or authorized agent.
E.
Any other person or persons so authorized by the Board
of Trustees by resolution at an open meeting of the Board of Trustees
to enforce any provision or provisions of its local laws.
Appearance tickets shall be issued in compliance
with Article 150 of the Criminal Procedure Law of the State of New
York.
A.
An appearance ticket issued and served pursuant to
this chapter for violation of any of the ordinances, codes or local
laws of the Incorporated Village of Valley Stream shall be returnable
in the Village Justice Court on the first Wednesday of any month at
7:30 p.m. and shall be substantially in the following form:

This summons shall be in triplicate, with the original
being served upon the defendant, the second copy sent to the court,
along with the accusatory instrument, and the third kept in the files
of the issuing office.
All ordinances, local laws or resolutions or
parts of ordinances, local laws or resolutions of the Village of Valley
Stream inconsistent with the provisions of this chapter are hereby
repealed; provided, however, that such repeal shall be only to the
extent of such inconsistency, and in all respects this chapter shall
be in addition to other legislation regulating and governing the subject
matter covered by this chapter.
If any section, paragraph, subdivision or provision
of this chapter shall be adjudged invalid or held unconstitutional,
the same shall not affect the validity of this chapter as a whole,
or any part or provision thereof, other than the part so decided to
be invalid or unconstitutional.
This chapter shall take effect immediately as
provided by law.
