Storage of flammables — See Ch.
31.
No plant, tank or station for the storage of
gasoline, shale oil, or the liquid product thereof, or of coal tar
or of any volatile flammable liquid of an explosive nature shall be
erected or maintained within the Village of Valley Stream without
a permit therefor in accordance with the provisions of this chapter
and issued as hereinafter provided.
No permit for a tank for the storage of flammable liquids shall be granted unless such tank is buried underground as provided in §§
17-7 and
17-8 hereof.
No permit shall be granted for any tank which
is intended for the storage of any flammable liquid other than flammable
liquids of Class III of the classes of flammable liquids as classified
by the National Fire Protection Association in the National Fire Codes
for flammable liquids and gases, and it shall be unlawful to store
any flammable liquids other than those included in Class III of the
classes of flammable liquids of the National Fire Codes for flammable
liquids and gases, in the Village of Valley Stream, except as expressly
provided for in this chapter.
No such tank shall be placed under any sidewalk
or extend beyond the building line of any street or highway.
Detailed plans and specifications covering the
proposed tank or tanks shall be submitted to the Superintendent of
Public Works for his approval when application is made for a construction
permit.
No tank shall, after the construction thereof, be put into use until an inspection shall have been made by the Superintendent of Public Works or his duly authorized representative and the conditions of such construction, as provided in §§
17-7 and
17-8 hereof have been complied with.
The top of every such tank shall be buried at
least two feet below the surface of the ground and at least two feet
below the level of the lowest cellar floor of any building or structure
within a radius of 10 feet. No such tank shall be buried beneath any
structure.
Prior to installation, every such tank shall
be protected against corrosion on the outside in a method at least
equivalent to two preliminary coatings of red lead followed by a heavy
coating of asphalt.
When tanks are buried under driveways subject
to traffic by heavy vehicles, the total coverage above the top of
the tank shall be not less than three feet; provided, however, that
where such driveways are paved with concrete, not less than six inches
in thickness, the total coverage may be reduced to two feet.
Every such tank shall be constructed of galvanized
steel, open hearth steel or wrought iron, of a thickness determined
in accordance with the regulations of the National Fire Protection
Association.
No permit shall be granted for any tank with
a capacity of more than 100,000 gallons.
Nothing herein contained shall be construed
to apply to the installation of a tank or tanks for the storage of
fuel oil to be used exclusively for the heating of the premises upon
or in which said installation is made; provided, however, that such
tanks be constructed and installed in accordance with all other requirements
set down by the Village of Valley Stream for the construction and
installation of such tanks.
Nothing herein contained shall apply to the
storage and sale of flammable liquids in paint stores, hardware stores
or similar retail establishments where said flammable liquids are
stored or sold in sealed Interstate Commerce Commission containers,
drums, or barrels; provided, however, that any dispensing from the
containers, drum or barrels shall be done by means of leakproof pumps
and not by faucet or other bottom-drawing device which will permit
gravity flow of liquid.
Nothing herein contained shall apply to the
retail storage and sale of gasoline in a lawful gasoline station dispensing gasoline by pump to automobiles. It shall be
lawful for such gasoline stations to store and sell gasoline on the
premises, provided that all tanks for the storage of said gasoline
are buried underground with the top of the tank at least two feet
below the surface of the ground. No such tank shall exceed a capacity
of 2,000 gallons nor shall any such tank be placed within 10 feet
of any building or property line. All such tanks shall be installed
in accordance with the regulations of the National Fire Protection
Association.
All ordinances or parts of ordinances of the
Village of Valley Stream inconsistent with the provisions of this
chapter are hereby repealed; provided, however, that such repeal shall
be only to the extent of such inconsistency and in all other respects
this chapter shall be in addition to the other ordinances regulating
and governing the subject matter covered by this chapter.

Every violation of this chapter, or any part
thereof, shall be punishable by a fine or penalty of not more than
$2,000 and/or 15 days in jail. When a violation of this chapter or
any part thereof is continuous, every 24 hours thereof shall constitute
a separate and distinct violation. Every violation of this chapter
or any part thereof shall constitute disorderly conduct, and any person
violating this chapter or any part thereof shall be and hereby is
declared a disorderly person.
This chapter shall take effect immediately.
