The Board of Trustees finds and declares that § 121 of the Agriculture and Markets Law represents a reasonable means of regulation and enforcement in respect to so-called dangerous and vicious dogs. However, the Board of Trustees also finds and declares that certain types of dogs, trained for the specific purposes of intimidation, physical aggressiveness and attack, are inherently dangerous and vicious in a manner not contemplated or addressed by state law. Therefore, the Board of Trustees finds and declares it is necessary to restrict, within the Village, dogs that are trained in and with respect to which the only salient purpose is in connection with intimidation, physical aggressiveness and attack.
As used in this chapter, the following terms shall have the meanings indicated:
ATTACK DOG or GUARD DOG
A dog which is trained for personal protection, area protection and/or the apprehension and/or warding off of an individual or individuals by means of barking, threatening gestures, biting or restraining by the use of its teeth and is primarily used to guard commercial and/or business premises.
It shall be unlawful in the Incorporated Village of Valley Stream to own, maintain and/or harbor within the Village an attack dog or guard dog.
A violation of this chapter shall be punishable, in the case of a first conviction, by a fine not to exceed $500 and, in the case of a second conviction, by a fine not to exceed $1,000.
