A. 
No person shall engage or conduct a business of maintaining, installing or altering, repairing or contracting to install, alter or repair any plumbing in the Incorporated Village of Valley Stream until such person shall apply for and obtain a master plumber's license to engage in such business as herein provided.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
MASTER PLUMBER
A person duly qualified and licensed by the Incorporated Village of Valley Stream to engage in the work of installing, setting up or putting together any plumbing fixtures, water or gas piping or appurtenances of any kind which are connected or are to be connected with the sewerage system of a building or in the work of connecting such plumbing fixtures, pipes or appurtenances with a sewerage system.
A. 
Any person desiring a master plumber's license shall make a sworn application in writing, accompanied by a filing and examination fee of $60, not returnable, and by two photographs of the applicant, approximately 1 1/2 inches by 1 1/2 inches, taken within the past 30 days, to the Examining Board who, if said application is in good order, shall refer it to the Board. The Board shall thereupon arrange and conduct an examination as to the competency and qualifications of such applicant within six months of the date of said application; except that where the applicant is, at the time of taking the application, a duly licensed master or employing plumber in any other municipality in Nassau County, he shall submit a certified or photostat copy of a certificate of competency or license issued by such municipality. If he shall maintain his principal place of business or reside in such municipality, examination hereunder be waived, provided that such municipality has adopted an ordinance waiving examination of a master plumber's license under this code on application for a license to do plumbing in said municipality. The fee, however, in such cases shall be the same as for those requiring examination by the Board. No partnership, corporation or other business entity shall engage in soliciting or performing any plumbing work, unless at least 51% of the control, interest or voting capital stock of such partnership, corporation or other business entity is unconditionally owned by one or more licensed master plumbing contractors.
B. 
After such examination, said Board shall endorse on said application its recommendation of approval or disapproval of the application and shall issue a master plumbing license or reject the applicant.
C. 
A fee of $125 shall be paid at the time a master plumber's license is issued.

D. 
Every license shall expire on the 3lst day of December of the year of its issuance, but may be renewed without examination for each succeeding year on the payment of $75 for two years; provided, however, that such renewal is applied for prior to February 1 of the year following said expiration date. If such renewal is not applied for by January 31 of the succeeding year, it will be necessary for payment of the full fee of $125 to be made. Any license not renewed within a period of one year from its expiration date becomes null and void.

E. 
Persons who have plumbing license of other municipalities. Anything contained in this code to the contrary notwithstanding, any person who holds a valid certificate of competency or license to conduct the trade or business of an employing or master plumber duly issued by any municipality which is a party to a reciprocal licensing compact to which the Incorporated Village of Valley Stream is also a party shall be deemed to be competent to conduct that business in the Incorporated Village of Valley Stream, New York, and shall not be required to obtain a certificate of competency from the Examining Board of Plumbers of the Incorporated Village of Valley Stream, New York, as a prerequisite to conducting that business in the Incorporated Village of Valley Stream, New York, but he must comply with and shall be subject to and bound by all other provisions and requirements of this code and by all rules and regulations adopted pursuant thereto.
F. 
As of January 1, 1988, the Incorporated Village of Valley Stream became participants of the Tri-Town Plumbing Licensing Agreement.
A. 
Whenever a licensed master plumber shall retire from business or remove his place of business from the place named in his application for license, the Building Department shall be notified of such retirement or removal and shall be given the address of the new place of business in case of emergency.
B. 
Any licensed plumber who because of his employment shall be subjected to a conflict of interest shall surrender his license to the Examining Board within 60 days of such employment. At the termination of such employment, his plumbing license shall be immediately restored upon payment of the current registration renewal fee.
C. 
Any licensed plumber who has a certificate of competency from the Incorporated Village of Valley Stream may temporarily shelve his or her license by submitting a letter notifying the Village and payment of $10 per year.
A. 
Any license may be revoked or suspended by the Plumbers' Examining Board for any violation of the provisions of this code after a hearing duly held by said Plumbers' Examining Board. Such hearing shall be held after at least 10 days' notice to such licensee. Said notice shall be served on such licensee in person or by registered mail sent to such licensee's last known address.
B. 
Licenses may be revoked or suspended for violation of any of the provisions of this code and for any of the following causes:
(1) 
Failure to file application for permit prior to installation of plumbing work.
(2) 
Failure upon receipt of violation notice to take the action called for.
(3) 
Performance of plumbing work in a manner contrary to the requirements of the Plumbing Code.
(4) 
Any improper or fraudulent practice shown by the Board to exist after hearing.
(5) 
For renting or lending a license.
(6) 
For conviction of a felony.
(7) 
For altering or defacing a certificate of inspection or approval.
(8) 
For filing of an application for a person or persons not licensed as a master plumber by the Incorporated Village of Valley Stream.
No master plumber shall directly or indirectly allow his license to be used in connection with work not actually done by him or his employees under his supervision.
Every master plumber shall file with the Building Department before beginning operations under his license, and upon each renewal of said license, a surety company bond, approved by the proper authority, in the penal sum of $2,000 indemnifying and saving harmless the Incorporated Village of Valley Stream of and from all damages or claims for damage to a public sewer, water service mains or pipes, to a highway or the surface thereof, to public or private property or to any persons, arising from unlawful or negligent acts omissions of said master plumber, his agents or employees, or anyone operating under the authority of his license, in making connections with a public sewer, in opening a public sewer, or making an opening or excavation in a public highway, public square or public park, or in maintaining, guarding, refilling or working in and about such opening or excavation, or in maintaining or guarding objects or materials taken from such opening or excavation or used in connection therewith. Said bond shall remain in full force and effect until the 31st day of December of the year of its issuance, unless sooner canceled by the Superintendent of Public Works, and shall be and remain security for indemnity for damages, as aforesaid, during the time it is in force. The above bond shall be filed with the Building Department only when the plumber does this type of work.

For operations of excavations in connection with sewer services, a public liability insurance policy to cover liability, if any, arising out of operations under permits indemnifying the Incorporated Village of Valley Stream as coinsured shall be on file with the Building Department in an amount not less than current minimum aggregate liability, which is $1,000,000 for a self-employed plumber in most municipalities, for all operations for street excavations in connection with sewer services and all plumbing work.
Any applicant refused a license hereunder may apply to the Village Board to reverse the Examining Board's determination.
