[Adopted 10-28-2002 by Ord. No. 2002-10]
This article shall be known and may be cited as the “Joint Municipal Solid Waste and Recyclable Materials Collection, Transportation and Disposal Services Ordinance.”
The background of this article and the legislative intention of the Board in enacting it are as follows:
A. 
The Township of Lower Allen is a municipality of the Commonwealth of Pennsylvania.
B. 
The Act of December 19, 1996, P.L. 1158, No. 177, referred to as the Intergovernmental Cooperation Law, 53 Pa. C.S.A. § 2301, et seq., provides that two or more municipalities may jointly cooperate in the exercise or in the performance of their respective governmental functions, powers or responsibilities.
C. 
The Pennsylvania First Class Township Code[1] authorizes Townships to enter into joint municipal agreements with other political subdivisions in making joint purchases of services and in performing governmental powers duties and functions.

D. 
The Pennsylvania First Class Township Code authorizes Townships to provide the means for the collection, destruction or removal of garbage and other refuse material.
E. 
The Board finds that it is in the best interest of its citizens to arrange for the joint contracting with other municipalities of solid waste and recyclable materials collection, transportation and disposal services in that the Township and its residents will realize a more economical cost.
A. 
The conditions of the agreement, the duration of the term of the agreement, the purpose and objectives of the agreement, including the powers and scope of authority delegated therein, the organizational structure necessary to implement the agreement and the manner in which personal property will be acquired, managed and disposed of are set forth in the agreement, a copy of which is attached to this article as Exhibit A and incorporated herein as if set forth in full.[1]

B. 
The Township of Lower Allen shall finance its obligations under the agreement out of its general revenues and will be reimbursed by charging its individual residents the fees established by the Board from time to time.
C. 
No real estate will be acquired, managed, licensed or disposed of under this article or the agreement.
D. 
Each municipality has the power to enter into contracts for policies of group insurance and employee benefits, including social security, for its employees; however, the services to be provided under the agreement will be rendered by a private contractor and no municipal insurance coverage will be required or purchased for the contractor's employees.
The President of the Board of Commissioners of Lower Allen Township is hereby authorized to execute the joint municipal agreement attached as Exhibit A.[1].
