Any sanitary sewer extension shall be constructed or reconstructed in accordance with the provisions of this article. It shall be the duty of each applicant, as defined in Chapter
220, Zoning, §
220-6C, contractor or subcontractor to comply with this article in the construction or reconstruction of any sanitary sewer extension within the Township.

Any person who violates or permits a violation
of this article shall, upon conviction in a summary proceeding under
the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be punishable by a fine of not more than $1,000,
plus court costs and reasonable attorneys' fees incurred by the Township
in the enforcement proceedings. Upon judgment against any person by
summary conviction, or by proceedings by summons on default of the
payment of the fine or penalty imposed and the costs, the defendant
may be sentenced to imprisonment for a term not exceeding 90 days.
Each day that such violation exists shall constitute a separate offense,
and each section of this article that is violated shall also constitute
a separate offense. In addition to or in lieu of enforcement under
this section, the Township may enforce this article in equity in the
Court of Common Pleas of Cumberland County.
In the event that strict compliance with the
terms and provisions of this article will result in an undue hardship
by reason of unique physical circumstances or conditions or limited
rights-of-way, the Board of Commissioners may grant a variance therefrom,
provided that such variance is necessary to enable installation of
the sewer line, manhole or other appurtenances, will not be detrimental
to the public interest or substantially impair the appropriate use
or development of adjacent property or utilities, will represent the
minimum variance that will afford provisions in issue and is in accordance
with generally accepted engineering practices.
