[HISTORY: Adopted by the Board of Supervisors of the Township of Lower Makefield 12-6-1993 as Ord. No. 285. Amendments noted where applicable.]
The office of Township Manager is hereby created by the Township of Lower Makefield, Bucks County, Pennsylvania, retroactive to the date it was first established within the township.
The Manager shall be appointed by a majority of the members of the Board of Supervisors. The Manager, in the absence of an employment agreement, shall serve at the pleasure of the Board of Supervisors and may be removed at any time by a majority vote of its members.

The Manager shall be chosen solely on the basis of executive and administrative abilities with special reference to actual experience in or knowledge of accepted practice with respect to the duties of the offices herein outlined. The Manager need not be a resident of the Township or the Commonwealth of Pennsylvania at the time of appointment, but within one year after his or her selection, the Manager shall reside at all times within a twenty-mile radius as measured from the Lower Makefield Township Building.

Prior to commencing the duties of Township Manager, the Township Manager shall give bond to the township with a corporate surety to be approved by the Board of Supervisors in an amount to be fixed by the Board of Supervisors in accordance with the requirements of the Second Class Township Code.[1]

The salary and other compensation of the Township Manager shall be fixed, from time to time, by the Board of Supervisors at a public meeting.
The Township Manager shall be the chief administrative officer of the township and shall be responsible to the Board of Supervisors for the proper and efficient administration of the affairs of the township. The powers and duties of the Township Manager shall be nonlegislative and shall relate to the general management of the township's business not expressly by statute or ordinance conferred upon any other township officers or employees. The powers and duties of the Manager shall include but not be limited to the following:
A. 
Supervision and responsibility for the activities of all municipal departments.
B. 
Subject to the requirements of the law and the township's personnel policies, to hire, to suspend, to discharge and to discipline all employees under the Township Managers' supervision; provided, however, that the Township Manager shall report at the next meeting of the Board of Supervisors any action taken by the Manager in furtherance of the provisions of this subsection.
C. 
In conformance with the provisions of the Second Class Township Code,[1] prepare and submit to the Board of Supervisors a proposed budget for the succeeding fiscal year together with a budget message.

D. 
Responsibility for the administration of the budget following its adoption by the Board of Supervisors.
E. 
Be designated to hold such other municipal offices and to head such municipal departments as may be directed by the Board of Supervisors.
F. 
Attend all meetings of the Board of Supervisors and to provide notice of said meetings in accordance with law.
G. 
In consultation with the Board of Supervisors, prepare the agenda for each meeting and supply sufficient information so that the Board is familiar with the topic prior to the public meeting.
H. 
Keep the Board of Supervisors informed as to the conduct of the township affairs including the submission of periodic reports and the making of necessary recommendations to the Board of Supervisors for action.
I. 
As soon as practical after the close of the fiscal year, submit to the Board of Supervisors a complete report on the financial and administrative activities of the township for the preceding year.
J. 
Assure the observance of all leases, franchises, permits and privileges granted by the township.
K. 
Manage the awarding of contracts in accordance with the provisions of law and supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon another township officer by statute or ordinance.
L. 
Assure the timely receipt of moneys payable to the township and that proper proceedings are taken for the security and collection of the same.
M. 
Act as a purchasing officer of the township in accordance with the provisions of the Second Class Township Code[2] and the township's policies and procedures, subject however, to the requirement of the submission of bids to the Board of Supervisors for acceptance.

N. 
Responsibility for all complaints regarding services or personnel of the township and the Township Manager or his designee shall investigate and attempt to resolve said complaints and report thereon to the Board of Supervisors.
Neither the Board of Supervisors nor any of its members or members of any board, commission or committee, subsidiary to the Board of Supervisors shall attempt any action effecting any employee of the township except as required or permitted by law and/or the provisions of the township personnel policy which has previously been adopted by the Board of Supervisors.
In the absence of the Township Manager from the township, the Township Manager may appoint an acting Manager in his/her stead. Said appointment, however, shall be subject to the approval of the Board of Supervisors and to the extent that the Board of Supervisors is unavailable to carry out its responsibilities, then the Township Manager may appoint an acting Manager in his/her absence until the next Board of Supervisors meeting.
