Borough of North Arlington, NJ Article VII Special Law Enforcement Officers

§ 54-38 Definitions.

All definitions in this article are as set forth in P.L. 1985, c. 439 (N.J.S.A. 40A:14-146.9 et seq.).

§ 54-39 Appointment; term; conditions.

A. All appointments of special law enforcement officers shall be made by the governing body for a term of one year. Special law enforcement officers shall not be continued as regular members of the Police Department and shall not be entitled to tenure.

B. All of the appointments shall be made in accordance with N.J.S.A. 40A:14-146.10 et seq., and all special law enforcement officers shall meet all the requirements therein.

§ 54-40 Classification.

Special law enforcement officers in the Borough of North Arlington shall all be classified as Class One under P.L. 1985, c. 439 (N.J.S.A. 40A:14-146.9 et seq.).

§ 54-41 Duties and restrictions.

A. The special police officer shall be authorized to perform routine traffic detail, supervisory functions and similar duties.

B. The use of a firearm or other defensive or offensive weapon by a special police officer is and shall be strictly prohibited, and no special police officer shall be assigned any duties which may require the carrying or use of a firearm or other defensive or offensive weapon.

C. The special police officer shall not have the authority or power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the Revised Statutes.

§ 54-42 Uniforms.

The Borough of North Arlington shall furnish all uniforms and insignia to all special law enforcement officers in accordance with N.J.S.A. 40A:14-146.12.

§ 54-43 When on duty.

The special police officer shall be deemed to be on duty while performing public safety functions on behalf of the Borough of North Arlington under this article.

§ 54-44 Supervision; compliance with rules and regulations.

Special law enforcement officers shall be under the supervision and direction of the Chief of Police and shall comply with the rules and regulations applicable to the conduct and decorum of the permanent, regularly appointed police officers in the Borough of North Arlington and any rules and regulations applicable to the conduct and decorum of special police.

§ 54-45 Statutory provisions.

Special law enforcement officers shall be and hereby are subject to and governed by all requirements, limitations and specifications set forth in N.J.S.A. 40A:14-146.8 et seq.
