The New Jersey Uniform Fire Code (N.J.A.C. 5:70-1.1
et seq.) and Uniform Fire Safety Act (N.J.S.A 52:27D-192 et seq.)
shall be locally enforced in the Borough of North Arlington.
The local enforcing agency shall be the Bureau
of Fire Prevention in the North Arlington Fire Department.
The local enforcement agency (or agencies) shall
enforce the Uniform Fire Code and the acts and regulations adopted
under it in all buildings, structures and premises within the established
boundaries of the Borough of North Arlington, other than owner-occupied
one- and two-family dwellings, and shall faithfully comply with the
requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by §
165-2 of this article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
This local enforcing agency established by §
165-2 of this article shall be a part of the North Arlington Fire Department and shall be under the direct supervision and control of the Fire Official and for administration purposes will report to the Chief of the North Arlington Fire Department.
Pursuant to N.J.S.A. 52:27D-206 and N.J.S.A.
52:27D-208 of the Uniform Fire Safety Act, any person aggrieved by
any order of the local enforcing agency shall have the right to appeal
to the Construction Board of Appeals of Bergen County.
In addition to the inspections and fees required
pursuant to the Act and the regulations of the Uniform Fire Code,
State of New Jersey, Department of Community Affairs, the following
additional inspections and fees shall be required:
A. All non-life-hazard use establishments shall have
fire inspections conducted annually.
B. Non-life-hazard use inspections fee schedule:
(1) Less than 1,000 square feet of floor area: $50.
(2) 1,001 to 3,000 square feet of floor area: $75.
(3) 3,001 to 7,500 square feet of floor area: $125.
(4) Over 7,500 square feet of floor area: $200.
The permit fees established by the Uniform Construction
Code are hereby incorporated into this article by reference.
Nothing herein contained shall be constructed in any way to affect the terms and provisions of Chapter
205, Land Development, or the Building Code of Borough of North Arlington.
