As used in this article, the following terms
shall have the meanings indicated:
PERSON
Any individual, copartnership, association, corporation or
joint-stock company or their lessees, trustees or receivers.
STREET
Any street, avenue, park, parkway, highway or other public
place.
TAXICAB
Any automobile, motorcar or other vehicle commonly called
a "taxi," engaged in the business of carrying passengers for hire,
which is held out, announced or advertised to operate or run over
any of the streets or public highways of this Borough, and particularly
accepts such persons as may offer themselves for transportation within
the Borough of North Arlington, provided that nothing herein contained
shall include autobuses, public liveries, jitneys or other such vehicles
which are hired by charter or for a particular contract agreed upon
in advance, or such public conveyances as are by law subject to state
and/or federal regulation exclusively.
It shall be unlawful for any person to operate
any taxicab or cause any taxicab to be operated within the Borough
of North Arlington without first having obtained a license therefor
from the Mayor and Council of the Borough of North Arlington, as hereinafter
provided.
Any person desiring to obtain a license for
the operation of a taxicab or taxicabs shall make separate application,
in writing, to the Mayor and Council for the granting of a license
for each vehicle. The application shall be made upon blank forms to
be furnished by the Borough of North Arlington and shall give such
information as may from time to time be deemed by the License Committee
of the Borough Council as requisite to determine the fitness of the
applicant to conduct the business and the adequacy of the vehicle
and equipment to be used. Every applicant for this license must be
a citizen of the United States and be at least 21 years of age. No
application shall be accepted by the Borough Clerk unless the same
shall be accompanied by the full amount of the license fee, as provided
herein. The said license when issued shall in no wise be construed
so as to permit an owner or operator to drive or operate a taxicab
without a taxicab driver's license.

A. Each applicant for a driver's license shall be at
least 21 years of age, a citizen of the United States or resident
alien of the United States and the holder of a state driver's license
issued by the State of New Jersey. Each applicant shall prove to the
satisfaction of the License Committee of the Borough Council that
he/she is in good health, with good eyesight, is able to read and
write the English language, is of good character and has knowledge
of the traffic regulations and geography of the Borough. The applicant
must furnish with his/her application two recent identification photographs
of himself/herself, approximately 1 1/2 inches by 1 1/2
inches, and a copy of his/her fingerprints taken by the Police Department
of the Borough.

B. All applications for taxicab driver's licenses shall
be made in writing to the Mayor and Council, shall be made upon blank
forms to be furnished by the Borough of North Arlington and shall
give, in addition to the information required by this section, such
further information as may from time to time be deemed by the License
Committee of the Borough Council as requisite to determine the fitness
of the applicant to act in the capacity specified. Each application
shall be accompanied by the full amount of the license fee, as hereinafter
provided.

A. All licenses issued under this article shall be good
and valid for one year from the date of issuance.

B. The fees to be paid for said licenses shall be as
follows:

C. The number of licenses to be granted for taxicabs
shall be limited to eight, and the number of licenses to be granted
to the operators of taxicabs shall be limited to three drivers for
each taxicab licensed.
Every driver or operator, when in charge of
a taxicab licensed under this article, shall have in his/her immediate
possession a valid taxicab driver's license and shall wear conspicuously
a metal badge containing his/her official taxicab driver's license
number. The license and badge shall be exhibited at any time upon
request by any member of the Mayor and Council, any police officer,
any duly authorized agent of said Borough or any passenger. Each taxicab
shall also carry, in such a position as to be visible to passengers,
a card approved by the License Committee containing a picture of the
operator and the official taxicab driver's license number.
The Mayor and Council of the Borough of North
Arlington are hereby authorized to designate, by resolution, such
places in the Borough as public stands for taxicabs as they may deem
expedient and proper, and they may give such direction regarding the
places and position to be occupied as public stands as they may deem
necessary to preserve order and promote public convenience. No vehicle
which is not licensed hereunder shall occupy any part of said public
stands as so designated. No taxicab, when not otherwise being used
for the purpose of transporting passengers, shall be parked on any
streets of this Borough at any time except at such place or places
as the Borough Council may from time to time designate as municipal
taxi stands.
No passengers shall be solicited for any taxicab
except by the driver thereof, and no person operating a taxicab shall
permit or allow any person or persons other than a passenger or passengers
being transported for hire in or about such taxicab when in service
as a taxicab.
No owner or driver of any taxicab shall induce
any person to employ him/her by knowingly misinforming or misleading
any such person, either as to the time or place of the arrival or
departure of any train or bus or as to the location of any hotel,
public or private place, nor shall any such owner or driver deceive
any person, make false representations to him/her or convey any passenger
to any other place or over any other route than that indicated by
the passenger.
A card containing the maximum rates of fare
to be charged shall be affixed in the inside of each vehicle so as
to be readily visible to a passenger, and no owner or driver shall
be permitted to charge at a rate in excess thereof.
Each taxicab owner shall, every three months,
cause each taxicab licensed pursuant to this article to be examined
by a reputable mechanic to be approved by the License Committee of
the Borough Council, and thereupon cause to be filed with the Borough
Clerk a written report prepared and signed by the mechanic, setting
forth a description of the taxicab and certifying the date and the
nature of his/her examination and inspection and that the vehicle
was found to be in a thoroughly safe condition for the transportation
of passengers. The cost of said inspection and certification shall
be paid by the licensee.
Any member of the Mayor and Council of the Borough
of North Arlington, the Chief of Police or any authorized agent of
the Borough shall have the right at any and all times to inspect any
and all licensed vehicles.
There is hereby reserved to the Mayor and Council
the right to make such rules and regulations in relation to the operation
of taxicabs and the conduct of the operators thereof as it may from
time to time determine to be necessary and proper in the best interests
of the citizens of the Borough. It is further declared that any violation
of such rules and regulations, as made by the Mayor and Council of
the Borough of North Arlington, shall constitute a violation of this
article, punishable as hereinafter provided.

Any person, firm or corporation who shall violate a provision of this article or fail to comply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, shall severally, for each and every such violation and noncompliance, be subject to the penalties in Chapter
1, Article
I, General Penalty.
