As used in this chapter, the following terms
shall have the meanings indicated:
OFFAL, REFUSE, RUBBISH, GARBAGE and COMBUSTIBLE AND NONCOMBUSTIBLE
WASTES
Are interchangeable and include the following:
A.
Refuse, garbage and combustible and/or noncombustible
waste solids.
B.
Animal and/or vegetable waste solids resulting
from the handling, preparation, cooking and consumption of food. Animal
waste shall not include animal excrement. Disposal of any animal excrement
shall be in accord with regulations promulgated by the Board of Health.
C.
Rubbish, including miscellaneous materials such
as rags, paper products, cardboard, periodicals, leather goods, rubber,
bottles, tin cans, broken glass, crockery, metal, cuttings and similar
materials. Rubbish shall not include material in the nature of trees,
stumps, branches, logs, earth, sand, lumber, brick, stone, plaster
or other substances that may accumulate from building operations.

D.
Ashes, including residue of combustion from
any type of solid fuel, such as wood, coal, coke, charcoal or like
substances.

E.
Nonputrescible solid wastes of both combustible
and noncombustible wastes.
F.
Putrescible and nonputrescible solid wastes
(except body wastes), including garbage, rubbish, ashes and solid
market and industrial wastes.
PERSON
Any individual, partnership, association, corporation or
other legal entity.
Every person placing garbage, ashes, refuse
or other matter, hereinbefore defined, for the collection from, on
or in connection with residential property or residential units, food-handling
establishments or businesses and factories, which property shall be
within the boundaries of a garbage collection district heretofore
established by the Borough of North Arlington, shall have such collection
and removal provided for them by the Mayor and Council of the Borough
of North Arlington.

The provisions of this chapter and all the rules
and regulations promulgated pursuant hereto shall be enforced by the
members of the New Jersey State Police Department, Bergen County Police
Department, North Arlington Police Department, Health Officer and
any employee of the North Arlington Board of Health. Said persons
shall have such duties and powers as shall be prescribed by the Board
of Health of the Borough of North Arlington and shall have power
to issue summonses for any violation of any section of this chapter
and other violations of rules and regulations promulgated hereto.

An article to establish requirements for the proper handling
of yard waste in Borough of North Arlington, so as to protect public
health, safety and welfare, and to prescribe penalties for the failure
to comply.
For the purpose of this article, the following terms, phrases,
words and their derivations shall have the meanings stated herein
unless their use in the text of this article clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or
other vessel, such as to prevent the yard waste from spilling or blowing
out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm,
association, or political subdivision of this state subject to municipal
jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.
The owner or occupant of any property, or any employee or contractor
of such owner or occupant engaged to provide lawn care or landscaping
services, shall not sweep, rake, blow or otherwise place yard waste,
unless the yard waste is containerized, in the street. If yard waste
that is not containerized is placed in the street, the party responsible
for placement of yard waste must remove the yard waste from the street
or said party shall be deemed in violation of this article.
The provisions of this article shall be enforced by the Police
Department and the Health Department of the Borough of North Arlington.
Any person(s) who is found to be in violation of the provisions
of this article shall be subject to a fine not to exceed $500.
Each section, subsection, sentence, clause and phrase of this
article is declared to be an independent section, subsection, sentence,
clause and phrase, and the finding or holding of any such portion
of this article to be unconstitutional, void, or ineffective for any
cause, or reason, shall not affect any other portion of this article.
This article shall be in full force and effect from and after
its adoption and any publication as may be required by law.
