No person, firm or corporation shall sell, offer or expose for sale or have in possession for sale or delivery in the Borough of North Arlington any milk, cream or milk product without first obtaining from the Department of Health of the Borough of North Arlington a license for such sale or delivery.
Said license shall be issued the first day of July and shall expire on the last day of June the following year, and will not be issued unless said Department of Health is satisfied that the provisions of this article as well as the laws of the state will be complied with.
Every person, firm or corporation obtaining a license for the sale or distribution of milk, cream or milk product in the Borough of North Arlington shall pay annually to the Department of Health a fee of $5 for each store, wagon, truck, motor vehicle, milk plant, milk depot or premises used in the process or distribution of milk, cream or milk product in the Borough of North Arlington.
Every license issued by the Department of Health of the Borough of North Arlington for the sale or distribution, bottling or manufacture of milk, cream or milk product shall be issued in the name of the owner of the vehicle, store, bottling plant, depot, station or manufacturing plant in which milk, cream or milk product shall be sold, distributed, produced or handled.
Such licenses shall not be sold, assigned or transferred and may be revoked by the Department of Health if the ordinances of the Borough of North Arlington and the laws of this state are not strictly complied with.
No milk, cream or milk product shall be delivered, stored or transported at a temperature exceeding 45° F., nor shall ice which is obtained from a source which is contaminated or which is so situated that it may become contaminated be used for cooling milk, cream or milk product. The Health Officer is hereby empowered to immediately confiscate and destroy, without previous notice to the violator, all milk, cream or milk product found being stored, delivered or transported in violation of this section.
