It shall be unlawful in this Township to sell or distribute alcoholic beverages otherwise than as provided in this article and the Alcoholic Beverage Law, constituting Chapter 1 of Title 33 of the Revised Statutes of New Jersey.
The Township Committee shall constitute the authority for the administration of the issuance of licenses hereunder.

The annual fees for alcoholic beverage licenses, both plenary retail consumption licenses and retail distribution licenses, hereafter issued in this Township shall be as follows:

The number of plenary retail consumption licenses issued and outstanding at the same time in this Township shall not exceed two, and the number of plenary retail distribution licenses issued and outstanding in this Township shall not exceed one.

No plenary retail consumption or club licenses shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage in this Township between the hours of 2:00 a.m. and 6:00 a.m.

No retail distribution license shall allow, permit or suffer the sale, service or delivery of any alcoholic beverage at retail in its original container for consumption off the licensed premises between the hours of 10:00 p.m. and 8:00 a.m. the following day.
During the hours sales of alcoholic beverages are hereinfore prohibited, no persons shall be admitted to or permitted to remain upon the licensed premises excepting the licensee or bona fide employees of the licensee.
The hours herein referred to shall be the standard time of this state as designated by the Revised Statutes of New Jersey, Title 1, Chapter 1, Section 2.3.
No licensee shall sell, offer for sale, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage, directly or indirectly, to any person under the age of 21 years, or allow, permit or suffer the consumption of any alcoholic beverage by any such person upon the licensed premises.
Each retail consumption licensee shall provide on the licensed premises separate sanitary toilet facilities for both sexes.
Any person who shall sell, serve, deliver or distribute any alcoholic beverages without having complied with or in violation of any of the provisions of this article shall, upon conviction thereof, be subject to a fine of not exceeding $200 or imprisonment for a term of not exceeding 90 days, or both, in the discretion of the magistrate before whom such conviction shall be had.
Any license issued pursuant to this article may, upon notice and hearing as required by N.J.S.A. 33:1-31, be suspended or revoked for violation of any of the provisions of this article or of any of the provisions of the Alcoholic Beverage Law hereinbefore referred to or of any of the rules and regulations promulgated by the State Commissioner of Alcoholic Beverage Control.

No other kind of alcoholic beverage license shall be issued in the Township of Shamong, except for Class A licenses issued for one or more of the following: limited brewery license, N.J.S.A. 33:1-10(1b); restricted brewery license, N.J.S.A. 33:1-10(1c), for operation of a brewpub; plenary winery license, N.J.S.A. 33:1-10(2a); farm winery license, N.J.S.A. 33:1-10(2b); instructional wine-making facility, N.J.S.A. 33:1-10(2d); plenary distillery license, N.J.S.A. 33:1-10(3a); and limited distillery license, N.J.S.A. 33:1-10(3b).

Is shall be unlawful for any person to consume alcoholic beverages within the Township of Shamong:
A. 
While in or on a public street, lane, sidewalk, public parking lot, public or quasi-public place or in any public conveyance.
B. 
In a private motor vehicle while the same is in motion or parked in or upon any public street, lane or public parking lot.
C. 
While upon any private property not his own without the express permission of the owner or public person having authority to grant such permission.
D. 
While in or upon any Township park, recreation facility, parking area or any other Township property.
The possession by any person of an opened alcoholic beverage container in any of the places designated above and which container has less contents therein than a similar unopened container shall be prima facie evidence that the person possessing the container consumed its contents or part thereof in the places designated above.
It shall be unlawful for any person to discard alcoholic beverage containers within the Township of Shamong upon any public street, lane, sidewalk, public parking lot, public or quasi-public place or upon any private property not his own without the express permission of the owner or other person having authority to grant such permission.
The person or entity holding an event for which a special alcoholic beverage permit has been authorized by the Township Committee and those persons in attendance at any such function with the permission of the sponsor thereof shall not be considered to be in violation of the provisions of § 51-14A, C or D of this article while such function in lawfully taking place.

Any person, firm, corporation, association or legal party whatsoever who or which shall violate, or authorize or procure a violation, or cause to be violated, any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty, § 1-15, governing general penalty provisions.
