All trees in the public domain, including those located in City
rights-of-way and parks on City property, are subject to the provisions
of this chapter.
The City Council does hereby establish a Tree Committee for
the review of all matters concerning City trees as defined in this
chapter, and other responsibilities as determined by the Council.
The Committee, which is to be appointed by the Mayor with consent
of the Council, will consist of citizens of the City with particular
expertise or interest in trees, parks and environment. The Committee
is also authorized to sponsor educational activities that:
A. Increase public appreciation of the aesthetic, historical and ecological
value of trees on public and private land; and
B. Encourage the citizens of the City to adopt installation, removal
and maintenance practices that promote and protect healthy trees on
private land.
No person shall prune, alter, remove or destroy, or cause the
pruning, alteration, removal or destruction, of a tree, or undertake
any action that will substantially impair the health or growth of
a tree of any size or description, located in the public right-of-way
or on City property unless authorized by the City Manager pursuant
to state law and relevant City right-of-way agreements or easements.
A violation of §
147-5 shall constitute a municipal infraction, for which a fine of $200 may be imposed for each violation.
