This article adopts a police Mutual Assistance Agreement among the Townships
of North Coventry, East Coventry, Lower Pottsgrove, Upper Pottsgrove, West
Pottsgrove, and the Borough of Pottstown, which municipalities are members
of the Pottstown Area Council of Governments. The Police Mutual Assistance
Agreement provides:
A. That the said municipalities will render to each other,
without charge, assistance in police protection with such personnel and equipment
as are available and necessary;
B. That such assistance is to be given on a voluntary basis
and once furnished may be withdrawn at any time;
C. That such assistance may be furnished upon request by
the Chief of Police or officer in charge of the municipality requesting assistance,
made directly to the Chief of Police or officer in charge of the municipality
providing such assistance;
D. That police officers of the municipalities rendering
assistance will have all the rights, powers and privileges of the municipalities
requesting assistance, and will be under the supervision of the police officer
in charge of the requesting municipality;
E. That any police officer employed by a municipality to
this Agreement, serving within the territorial limits of any other municipality,
pursuant to a request under this Agreement, shall at all times remain the
employee of the municipality originally employing him, and the municipality
furnishing assistance shall at all times be responsible for his wages, workmen's
compensation and all other duties and responsibilities pertaining to his employment.
Any equipment used in furnishing such assistance shall be considered as equipment
used in performance of police duties within the territorial limits of the
municipality furnishing the equipment. No charge or expense shall be imposed
against any party to this Agreement for assistance rendered hereunder;
F. That the sounding of a burglar alarm of a financial institution,
or the report of a responsible citizen that a police officer is in dire need
of and is unable himself to request aid will be deemed a "request of assistance";
G. That each municipality will provide the others with a
list of all police officers employed, including name, rank and designation
of full-time or part-time status, which list shall be corrected as required;
H. That each municipality may withdraw from the Agreement
without destroying the force and effect of the Agreement among the remaining
municipalities, upon written notice to all remaining parties, specifying the
date of withdrawal.
