A. 
As used in this chapter, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGES
Any beverage, liquor, wine, beer, lager beer, ale, porter or similar fermented beverage containing ethyl alcohol of any degree of proof, and including synthetic ethyl alcohol, but not including ethyl alcohol that has been denatured or otherwise rendered unfit for beverage purposes.
ON OR ABOUT THE PERSON
The location of any container, bottle or can containing any alcoholic beverage which is nearby, close at hand, convenient of access and within such distance of the parties so having it as that such party could without materially changing his position, get his hand on it.
OPEN
The condition of a container whose cap, cork, tab, top or other closing device has been removed or the condition of a can or bottle which has been punctured or pulled or twisted or screwed open so as to break its seal.
POSSESSION
The exercising of conscious dominion or control over any container, bottle or can containing an alcoholic beverage.
PUBLIC PLACE
Any place to which the general public has access and a right to resort for business, entertainment or other lawful purpose, but the term does not necessarily mean a place devoted solely to the uses of the public. It shall also include the front or immediate area of any store, shop, restaurant, tavern or other place of business, or any mall area or parking area to which the public has access, and also public grounds, areas or parks.
B. 
In this chapter, the singular shall include the plural and the masculine shall include the feminine.
A. 
No person shall have on or about his person, possess carry or transport liquor, wine, beer or other alcoholic beverages in open containers in or about any public sidewalk, street, alley, walkway, public park or playground, or any other public place in the Township of North Coventry. No person shall drink or consume liquor, wine, beer or other alcoholic beverages in or about any street, sidewalk, alley, walkway, public park or playground or any other public place in the Township of North Coventry except as hereinafter provided.
B. 
Possession and consumption of alcoholic beverages may be permitted on Township property under such regulations as shall be promulgated from time to time by the Board of Supervisors of North Coventry Township or by the North Coventry Township Parks and Recreation Commission.
C. 
Any person or persons desiring to possess and consume alcoholic beverages on any Township property may do so only after obtaining a written permission from the Board of Supervisors of North Coventry Township or the North Coventry Township Parks and Recreation Commission.
D. 
Failure to obtain written permission as aforesaid in § 104-2C shall constitute a violation of this chapter and shall be subject to the penalties provided in § 104-3 herein.
Any person who violates or permits a violation of this chapter, shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
