The owner of any lands upon which is situate any apartment house or
multiple apartment houses and the owner of any other property having one or
more rental units situate on a tract of land in North Coventry Township shall
declare to the Township, on forms available from the Township Tax Collector,
the name, age and occupation of each and every occupant of every apartment
or rental unit located on said property.
After April 15, 1991, the landowner shall update said declaration and
file the same with the Township Tax Collector. For those properties with four
or fewer rental units, such reports shall be made on a quarterly basis and
shall be submitted by the following dates of each year thereafter: March 15,
June 15, September 15, December 15. For those properties with five or more
rental units, such reports shall be on a monthly basis and shall be due by
the 10th of each month.
The Township Tax Collector is hereby authorized to establish the form
of said declaration and cause the same to be printed.
Any person who fails, neglects, or refuses to make the declaration required
by this chapter shall, upon being found liable therefor in a civil enforcement
proceeding commenced by the Township before a Magisterial District Judge,
pay a fine of not more than $600, plus all court costs, including reasonable
attorney's fees, incurred by the Township in the enforcement of this chapter.
No judgment shall be imposed until the date of the determination of the violation
by the Magisterial District Judge. If the defendant neither pays nor timely
appeals the judgment, the Township may enforce the judgment pursuant to the
applicable Rules of Civil Procedure. Each day a violation exists shall constitute
a separate offense. Further, the appropriate officers or agents of the Township
are hereby authorized to seek equitable relief, including injunction, to enforce
compliance herewith
