It shall be unlawful for any person under the age of 18 years of age to be or remain in or upon any of the streets, highways, alleys, parks, shopping centers, or other public places in the Township of North Coventry, unless such person shall be accompanied by a parent, guardian or other person having legal custody of such minor during the following dates and times:
A. 
At night, from the first day of April to the 30th day of September, inclusive, of each year, at any time between the hours of 10:00 p.m. and 5:30 a.m. Eastern Standard Time, or, as the case may be, Eastern Daylight Saving Time, when said time is in effect.
B. 
At night, from the first day of October to the 31st day of March, inclusive, between the hours of 9:30 p.m. and 5:30 a.m. Eastern Standard Time, or, as the case may be, Eastern Daylight Saving Time, when said time is in effect.

It shall be unlawful for any parent, guardian or other person having the legal custody or care of any person under 18 years of age to permit or allow any such child, ward, or person under such age, while in such legal custody to go on or be in the Township of North Coventry between the hours named and prescribed in § 156-1 of this chapter.[1]

Any parent, guardian, legal custodian and/or child violating provisions of § 156-1 or 156-2 of this chapter shall be subject to prosecution commenced by any police officer of the Township and shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.

Each justice of the peace of the Township shall, upon the arrest of any person under the age of 18, brought before him for a violation of the provisions of § 156-1 of this chapter, inquire into the facts of said arrest together with the conditions and circumstances under which the said child was arrested; and, where it shall appear that such person so arrested is habitually disobedient or beyond the control of his parents or other lawful authority, or who so deports himself as to injure or endanger the morals, health or general welfare of himself or others, the said justice of the peace shall certify the case to the juvenile court, charging said child with having violated this chapter, for proceedings in accordance with the law in such cases.

Any child under 18 years of age in transit to or from work shall be exempt from the restrictions of this chapter. The burden of proof that such child was in transit to or from work shall fall upon the parent, guardian, custodian, or child charged under this chapter.
