No person, corporation or association shall
operate, conduct, give or maintain in the Borough of South Plainfield
in the County of Middlesex any amusement resort, bathing resort, dance
hall, theatrical show, exhibition, carnival or circus for money or
gain, nor shall any person, corporation or association combine the
selling or vending of any article or thing with the operation, conducting,
giving or maintaining of any such amusement resort, bathing resort,
dance hall, theatrical show, exhibition, carnival or circus, without
first obtaining a license therefor from the Council said Borough;
provided, however, that this section shall not apply to the operating,
conducting, giving or maintaining of any such amusement resort, bathing
resort, dance hall, theatrical show, exhibition, carnival or circus
or the selling of articles or things in connection therewith if the
entire proceeds of such enterprise are devoted or to be devoted to
charitable or benevolent purposes.
The Council shall have power to grant or withhold such license, and such licenses when granted shall be signed by the Mayor and countersigned by the Borough Clerk and shall state the name of the licensee, the purpose for which the license is granted and the date on which the license expires, and such license shall not be effective until the license fee provided in §
141-3 shall have been paid therefor to the Borough Clerk for the use of the Borough.
Each applicant for a license for a circus, carnival
or traveling show to be conducted out of doors or under tents must
submit proof of compliance with N.J.S.A. 34:15-71 (Employers' Liability
Insurance Law).
