The yard waste facility located on Kenneth Avenue is to be utilized for receiving grass, leaves and brush generated by residents of the Borough of South Plainfield. The method of disposing of grass, leaves and brush will be done in accordance with the rules and regulations established by the Mayor and Council of the Borough of South Plainfield. It shall also be subject to any existing or subsequently executed agreements between the Borough of South Plainfield and the Middlesex County Improvement Authority controlling and regulating yard waste recycling and marketing services.
The use of the yard waste facility is hereby restricted to either the owner-occupant or renter-occupant of property assessed as Class II residential, and grass, leaves and brush shall be transported to the yard waste facility in their private, noncommercial vehicle.
The following persons are prohibited from using the yard waste facility.
A. 
Persons who do not reside in the Borough of South Plainfield.
B. 
Persons wishing to deposit grass, leaves, or brush from places other than their homes in the Borough of South Plainfield.
C. 
Persons depositing grass, leaves, and brush from a business, commercial or industrial activity.
D. 
Commercial firms or landscapers.
A. 
The following materials shall be accepted in the yard waste facility:
(1) 
Brush: twigs, branches up to four inches diameter, shrubs.
(2) 
Grass clippings: freshly mown grass, no more than the equivalent of three thirty-gallon garbage cans at any one time.
(3) 
Leaves: in biodegradable paper bags only.
B. 
The Borough Clerk shall issue a yearly sticker to be affixed on the resident's private, noncommercial vehicle which shall qualify the resident to utilize the yard waste facility.
C. 
The window sticker shall be effective from April 1 of the calendar year until March 31 of the subsequent calendar year.
D. 
In the event that a resident is utilizing a vehicle not owned by them or a vehicle with commercial plates, they must obtain a one-day pass from the Borough Clerk's office in order to utilize the yard waste facility.
For each violation of any provision of this article there shall be a fine imposed not to exceed $1,000. In addition to the above penalties the violator will not be permitted to use the yard waste facility for a period of one year.
