It is the purpose of this chapter to assure the preservation and the
protection of lands and to minimize the public and private loss of land use
due to creation of wetland areas within the Town of Cicero.
It shall be unlawful for any person or firm to take any
action, either directly or indirectly, which would result in the creation
of wetlands, as that term is defined by the Department of Environmental Conservation
or Army Corp. of Engineers, anywhere within the boundaries of the Town of
Cicero.
Notwithstanding the foregoing provision, a person or
firm may apply to the Town Board of the Town of Cicero for permission to create
a wetland within the town. Such application shall include detailed drawings
of the land area affected, the purpose for creating the wetland, an environmental
impact statement detailing any and all impacts resulting from the creation
of the wetland and any other information the Town Board may reasonably request.
The Town Board may grant permission to create a wetland
upon terms and conditions it deems appropriate. In the event the Town Board
grants permission to create a wetland, it may require the person or firm to
post financial security in a sum necessary to create the wetland area in accordance
with the Board's requirements.
Any person or firm who violates this chapter or fails
to comply with its requirements shall, upon conviction thereof, be fined no
more than $250 or imprisoned not more than 15 days, or both. Each day of noncompliance
shall be considered a separate offense.
