Upon the basis of an engineering and traffic investigation, 30 miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of this Village. No person shall operate a vehicle on any highway or private road open to public motor vehicle traffic at a rate of speed in excess of the maximum herein established.
A. 
Every person convicted of a violation of this section shall be punished as follows:
(1) 
Where the Village Court enters that the speed upon which the conviction was based exceeded the applicable speed limit by not more than 10 miles per hour, by a fine of not less than $30 nor more than $100.
(2) 
Where the Village Court enters that the speed upon which the conviction was based exceeded the applicable speed limit by more than 10 miles per hour but not more than 30 miles per hour, by a fine of not less than $60 nor more than $200 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
(3) 
Where the Village Court enters that the speed upon which the conviction was based exceeded the applicable speed limit by more than 30 miles per hour, by a fine of not less than $120 nor more than $400 or by imprisonment for not more than 30 days, or by both fine and imprisonment.
B. 
Notwithstanding the foregoing provisions, the maximum fine provided herein for the violation for which the person is sentenced may be increased by an additional $100 if the conviction is for a second speeding violation committed within an eighteen-month period, and the maximum fine provided herein for the violation for which the person is sentenced may be increased by an additional $250 if the conviction is for a third or subsequent speeding violation committed within an eighteen-month period. Where an additional fine is provided by this subsection, a sentence of imprisonment for not more than 30 days may be imposed in place of or in addition to any fine imposed.

A. 
Title. This section shall be known and may be cited as the "Ancillary Vehicle Parking Law of the Village of Altamont."
B. 
Policy. It is the continued interest of the Board of Trustees and the residents of the Village of Altamont, New York, that the Village streets and rights-of-way are kept clear and open for the uninhibited passage of motor vehicles and emergency vehicles.
C. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ANCILLARY VEHICLE
Any type of trailer or similar equipment used to transport recreational vehicles, commercial equipment, snowmobiles, boats, personal watercraft and/or campers and motor homes.
D. 
Prohibited activity/conditions. It shall be unlawful for any person within the Village of Altamont to park an ancillary vehicle on any Village street for a period in excess of 72 hours during any calendar month. Notwithstanding the aforesaid seventy-two-hour period of parking, the aforesaid vehicles shall not be parked on Village streets for a continuous period in excess of 24 hours.
E. 
Penalties.
(1) 
In the event that an ancillary vehicle of the aforesaid type is parked in violation of this section, namely in excess of a continuous 72 hours and/or for a period under 72 hours in excess of one time per calendar month and/or in excess of 24 hours for all other times herein, the Altamont Chief of Police or any subordinate officer of the Altamont Police Department is hereby given the authority to remove said ancillary vehicle from said Village street and have said ancillary vehicle placed in storage. Any towing charges and accrued storage charges shall be the responsibility of the owner of said vehicle.
(2) 
Any person parking in violation of this section shall, upon conviction thereof, be sentenced to pay a fine not exceeding $50 for the first violation; each subsequent violation shall result in a fine not exceeding $100. This fine shall be in addition to any other provision for enforcement, namely the towing and storage of any vehicle in violation at the expense of the owner of said vehicle.
A. 
The parking of vehicles is hereby prohibited in any public parking area owned and maintained by the Village and on all highways within the Village between the hours of 12:00 midnight and 7:00 a.m. beginning November 1 and ending May 1 of each year. Every person convicted of a violation of this provision shall be subject to a penalty of $25 for each and every violation thereof.
B. 
Stop intersections. The intersection of Fairview Avenue and Grand Street is hereby designated as a stop intersection and a stop sign shall be erected on Fairview Avenue at its entrance to said intersection from the east and from the west.

Grand Street, Altamont, is designated for one-way traffic in a southerly direction between its intersection with Main Street and its intersection with Fairview Avenue on Sundays only from 8:00 a.m. to 10:00 a.m.
A. 
When any vehicle is parked or abandoned on any highway or in any public parking area within this Village during a snowstorm, flood, fire or other public emergency which affects that portion of the public parking area or highway upon which said vehicle is parked or abandoned, or when any vehicle is found unattended on any highway within the Village where said vehicle constitutes an obstruction to traffic, or when any vehicle is parked or abandoned in any public parking area or on any highway within this Village where stopping, standing or parking is prohibited, said vehicle may be removed by or under the direction of the Village police, Fire Chief or the Board of Trustees.
B. 
After the removal of any vehicle as provided in this section, the Village police may store such vehicle in a suitable place at the expense of the owner. Such owner, or person in charge of the vehicle, may redeem the same upon payment to the Village's designated vendor for towing vehicles, such payment to include all expenses actually and necessarily incurred in effecting such removal. In addition thereto, such owner or person in charge of the vehicle shall be subject to a penalty of $25 for each and every violation of this section.[1]

C. 
It shall be the duty of the Village police to ascertain to the extent possible the owner of the vehicle or person having the same in charge and to notify him/her of the removal and disposition of such vehicle and of the amount which will be required to redeem the same.
Vehicles which are equipped with lugs, cleats, or any contrivances liable to damage or deface roadway surfaces are hereby excluded from all public highways of this Village, excepting snow tires.
A. 
Where penalties are not specifically provided, every person convicted of a traffic infraction for a violation of any provision of this article shall, for a first conviction thereof, be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter such person shall be punished by a fine of not more than $100 or by imprisonment of not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction such persons shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or both such fine and imprisonment. The following minimum fines are established for the indicated offenses:
(1) 
Parking in prohibited area: $20.
(2) 
Parking in a handicapped parking area: $100.
(3) 
Parking double: $20.
(4) 
Parking more than 12 inches from curb: $20.
(5) 
Blocking driveway: $20.
(6) 
Obstructing fire hydrant: $25.
(7) 
Parking overnight: $25.
(8) 
Other offenses for which a minimum fine is not otherwise established: $25.
B. 
In the event that any violator fails to pay the designated fine for any of the above-enumerated offenses within 20 days from date of issuance of a ticket for said offense, the amount of the fine due shall automatically double, or, in the case of a not guilty plea being entered by a violator within 20 days from date of issuance of a ticket, then the amount of the fine due shall automatically double if said fine is not paid within 20 days from conviction after trial.

The parking lots owned by the Village of Altamont in the Village center and the designated street parking spaces within the Village's Central Business Zoning District are intended primarily to promote and serve the needs of Village business owners and their customers. The purpose of this article is to ensure that, to the extent practical, adequate parking spaces in these areas shall be available to meet these needs.
The parking regulations contained in this article shall apply to the three Village-owned parking lots located at Main Street (also known as the Train Station Lot) (hereafter "Main Street/Train Station"); and Maple Avenue, both the small lot and the large lot located behind the Enterprise building (hereafter "Maple Avenue small" and "Maple Avenue large," respectively).
A. 
There shall be a two-hour parking limit for all spaces in the Main Street/Train Station lot and the Maple Avenue small lot.
B. 
There shall be no parking limits in the Maple Avenue large lot, and overnight parking by area tenants shall be allowed.
A. 
Violations of the above regulations may be enforced and/or prosecuted by any officer of the Village Police Department in the manner provided by law.
B. 
The Village Board is authorized to appropriate and make available reasonable funds for the erection of signs to advise the public of the above regulations.
This article shall take effect immediately.
