Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
A. 
City Council members and Mayor.
B. 
Gubernatorial appointees serving on municipal boards.
Individuals serving in the following positions are exempt from Defined Contribution Retirement program membership pursuant to N.J.S.A. 43:15C-2:

Certified Health Officer.

A. 
Notwithstanding the provisions of §§ 46-1 and 46-2, any appointee to the positions of Business Administrator, Department Heads as defined under the Passaic City Code, pursuant to N.J.S.A. 40:69A-1 et seq., City Attorney, Municipal Prosecutor and Municipal Court Judge who was appointed to said position(s) listed above, and was a member of the Public Employees' Retirement System (PERS) prior to July 1, 2007, shall remain in PERS while serving in one or more of the appointed positions listed above, regardless of their date of appointment to one or more of the appointed positions listed above.
B. 
If an individual is appointed to one or more of the positions listed above and was not a member of PERS as of July I, 2007, he/she will only be enrolled in the State's Defined Contribution Retirement Program (DCRP).
