This chapter shall be known and cited as the "Village of Hamilton Farmers' Market Law."
Subject to the annual approval of the Village of Hamilton Board of Trustees, the Village of Hamilton Farmers' Market may be conducted annually in accordance with this chapter.

Persons selling any food, beverage or plant items that require a license or permit from the New York State Department of Agriculture and Markets or a sales tax certificate from the New York State Department of Taxation and Finance must provide a copy of such valid license, permit or certificate at the time of applying for a permit to sell at the Farmers' Market.
All vendors must apply for and obtain a permit from the Village of Hamilton in order to sell at the Farmers' Market.
Weekly permits will be issued only for seasonal produce, i.e., pumpkins, apples, etc.
Permit fees shall be as established from time to time by resolution of the Village of Hamilton Board of Trustees.
The following persons or groups are exempt from paying fees for noncurbside sale space: not-for-profit community service organizations participating for community service fund-raising efforts and full-time students 18 years of age or younger residing in the Village of Hamilton or any of the immediately adjoining towns. Only one exempt space per group or family shall be permitted.
The Village of Hamilton Board of Trustees is hereby authorized to promulgate rules and regulations pertaining to the proper conduct and operation of the Farmers' Market by resolution.
All vendors must comply with all applicable federal, state and local laws, ordinances and regulations.
The Mayor, the Board of Trustees and the Village of Hamilton Police Department or any other person duly authorized by resolution of the Board of Trustees, may enforce the regulations of the Farmers' Market in accordance with the provisions of this chapter.
Any person who is found to have violated or failed to comply with any provision of this chapter and the orders, rules, regulations and permits issued hereunder may be fined $25 for each offense. The Village of Hamilton Board of Trustees is authorized to revoke the permit of any vendor, at any time, who, in the opinion of the Board of Trustees, has violated any provision of this chapter or any regulations issued hereunder.
