The intent of the Board of Trustees in enacting
this chapter is to implement regulations governing the installation
and maintenance of satellite antennas, also known as "dish" antennas,
within the Village of Shortsville, so as to provide for the orderly
installation of such devices consistent with the preservation of the
beauty, character and general welfare of the community.
The Board of Trustees finds that modern technology
has brought about the invention and popularization of electronic devices
to enhance television reception. Such devices are installed outdoors,
where they are visible to surrounding properties and the general public.
The Board finds that it is necessary to provide for the orderly installation
and maintenance of such devices so that haphazard and unsightly development
is avoided. The purpose of this chapter is to provide for the maximum
development of private property consistent with the aesthetic appearance
of the properties within the Village of Shortsville.
This chapter shall govern the installation and maintenance of satellite antennas in the Village of Shortsville. The provisions of this chapter relating to procedural matters shall supersede the provisions of Chapter
95, Zoning, of the Code of the Village of Shortsville, except as to such provisions of Chapter
95 which specifically refer to this chapter.
The provisions of § 95-66 of the Code of the Village of Shortsville, relating to complaints of violations, violations and penalties, shall apply to violations of this chapter, including penalties for offenses, as the same are governed by Chapter
1, General Provisions, Article
II, General Penalty.
